Am I Eligible for Money Back Guarantee if Listing Doesn't Mention Anything about The Product?

Hey guys.

I need your opinion on something.

I wanted to buy an iPad pro 10.5, so I was going through ebay and checking other websites regularly to find a good deal. One day, I saw that an eBay seller is selling a brand new iPad pro 10.5 256gb for just $799!

But the seller had no description about the product. Just specifications. I contacted the seller using eBay messages and he said that the item is brand new, sealed, will come with standard apple warranty and tax invoice. (note: he said all these things on eBay messages, but nothing is there in the listing)

It seemed like a great deal. It even had an option to make a offer. I made an offer for $750 (just to see if it'll work). He accepted! I made the payment and ordered the product.

Seller accepts returns. Seller said that he will only take the product back if it's unopened. But how can I check the product without opening it? I can surely check the serial number on Apple's website but pretty much nothing else I can do.

eBay moneyback guarantee is there and PayPal buyer protection is there as well. But I'm not sure what exactly will happen if I get a fake or a different product. Like, what if the product isn't genuine, or is used, or is imported? Listing doesn't say anything. All the critical information was exchanged using eBay messages. Does that count in buyer protection schemes?

EDIT: I forgot to mention that the seller is new and only has 13 feedbacks. All of them are positive though. 100% positive feedback.

Also, I didn't post it here because seller only had 2 in stock and I got the last one.

    If this is the case, and assuming the seller is based in Australia, how much did you end up paying for shipping? Hopefully you have activated PayPal's returns program if something does go wrong

          The description is just the specifications. Says nothing about warranty, country of the iPad or invoice.

    I wouldn't buy a $700 item from a 13 feedback seller.
    What else have they sold, and what other items are they selling?

    • Just a few very low priced items. $50-60 or so.

        It could be that he won it and doesn't want it.. But more likely, the account is compromised and it's a scam.

  • When you file a dispute on eBay, it's based on the information. If there is "specifications" and the tablet does not meet the specifications. Or if there is "eBay messages" and the tablet is not actually the same as the eBay messages. If you receive something different, don't you think that eBay can see that the information is not aligned with the product received? You would include all that information in your dispute. Yes, eBay can refuse to honour a dispute, but if you have nothing to hide, then what's the problem?

    To be even more confident, video the unboxing procedure including the verification of the serial.

    It does seem cheap. Selling an unwanted gift? Cheapest 10.5 256GB iPad Pro on OzBargain was a couple months ago from Myer when it was $903. Next time, pay $104 more to grab the ozbargain and save yourself some nerves. https://www.ozbargain.com.au/node/327599

      You're right. The seller clearly doesn't know what they have and what's it's worth. Selling an iPad Pro for $750 is a ripoff price.

  • Just so you know, eBay buyer protection and Paypal protection are 1 of the same when making a claim.

    This means, if you claim via eBay, you cannot claim via Paypal even if you are not granted a return. Same goes in the reverse.

        Using other programs to address a concern

        Buyers can't use more than one resolution method to get a refund. After selecting a resolution process (eBay Money Back Guarantee, PayPal Purchase Protection, or requesting a chargeback from their payment provider) a buyer is required to use only that process to resolve the transaction issue.

        If a buyer requests a chargeback from their payment provider or files a PayPal Purchase Protection dispute, any requests opened through the eBay Money Back Guarantee for the same transaction are immediately closed.

        • I saw a couple of posts where people have done both. Anyway, I hope it doesn't come to that..

        • This only means you can't double dip your refund with eBay. eBay will close the case if you request chargeback from PayPal or CC. Doesn't say anything about PayPal will close the case if eBay refund case is unsuccessful.
