Strata Levy Not Correctly Accounted after Repeated Notifications

Even though all the levies was paid on time, Strata company says I haven't paid one levy.

The story is earlier they send me an invoice of a Misc payment which they think I have to pay, I refused to pay as its nothing to do with me. After couple of quarters (levy paid quarterly) they started to take that Misc invoice money from the Levy I am paying without notifying.

Now it shows I haven't paid levy and I cant vote at the AGM.

Anyone gone through the same type of drama? what i dont understand is how can they take money from levy and say i didnt pay the levy

Misc invoice -They cut a tree which was few meters away from my property .Tree is on common property. They wanted me to pay for it which I refused but they went ahead cut it and paid the tree lopping company and then Strata company send an invoice to me.

      • Who initiated the tree cutting - did you request it or was it an OH&S matter?
        Were you billed for the full costs, or your share (as a unit holder)?

        • Strata initiated it . I didnt request at all. I am not really sure why they did it. it was just a 5-7 m tree a small one. Here they dont consult anyone .There are couple of people in the committee and they do stuff the way they want. Yes they billed me for the cost. I told them its in common property but all I get is rude reply saying you have to pay. .

          If the tree is the common property, no matter itnis intial by the lot owner or not, if strata agreed then itnshpuld come out from the sinking fund.

          You will need to get vote and vote those EC out.

          How many unit block you have in your strata?

          What you will need to do first make application to fair trading for mediation.cost nothing.

          If not sucess then you will need to make application to NCAT cost $50. But you may need to understand the bylaw.

          Also ask your managing agent under what bylaw they have right to seek compensation if removing the tree from you.

        • @LoveBargain15: its a group of 22 units. As they made it now like I havent paid the levy, i dont have vote anymore.
          Whats the best way to vote them out?
          I am not really sure if they played with the bylaws. Wondering whether if they want to change a bylaw, do they need a majority , i mean 12 units out of 22 should agree? Or the committee can do it themselves?

          You need to vote them out by numbers, you can get proxy from owner that can't attend then you will have more vote.

          You need to clarify from them that why you need to pay not they say you need to then you need to. It has to be base on your strata plan by law.

          Changing bylaw shpuld be special resolution, 75% pass.
          Read your by law from your sale contract or ask your managing agent.

          You need to be frim.

  • Does the misc invoice only relate to you? or are you paying 1/(number of houses) of the outstanding debt?

    • They send it only to me, I asked 4 of my neighbors and they didnt get any
