[RESOLVED] Got Sent Wrong Item, Company Won't Send Courier to Pick Up Item. Am I Being Unreasonable?

Hi all. Would appreciate suggestions on how to go about this.

I bought a dxracer chair for $390 from umart (online). They sent me a thunderx3 instead ($280?). Fast forward and I'm now in an email battle with them. I don't have a car at the moment and don't honestly think I should be expected to hall some huge heavy box to the next suburb over to Australia post. If it came by courier then it should be removed by a courier, no?
My view has been pushed aside though. I tried suggesting they send a courier to pick it up and are met with "no. You take it to Australia post. I've emailed you the postal slip already" (they haven't done that either).

How would you guys approach this? Should they be expected to pick it up considering the huge dimensions and mass of the box?

Paid with PayPal so I'm considering just launching a case but I'm not sure there's grounds?

Update: One Paypal dispute message later and a courier has been booked. Thanks for the opinions. :)

    I don't think that's unreasonable at all. If they screwed up then it's on them to fix the situation. If they won't sort it out then I'd be inclined to go the PayPal route as well.

    Open an ISNAD with paypal, considering it is a completely different item.

    Just to give you strength in numbers, I agree with the other posters as well. They expect you to be put out for their error. No way.

    Please read this from ACCC.

    The relevant sections states

    When a product is too large, too heavy or too difficult to remove, the >business is responsible for paying the shipping costs or collecting the >product within a reasonable time of being notified of the problem.

    I would read the above link and format a reply email to the company mentioning above information also with the major issue of being not as described.

    Start with PayPal (was it ebay too?) if they don’t want to collect via courier raise the issue with ACCC or your states Fair Traiding.

      Note the "or".
      They have offered to pay the shipping costs, so they have complied.

      • But not in a manner that would alleviate it being a "difficult to remove item." The "or" needs to be read with regard to the whole of the preceding part of the sentence - "When a product is too large, too heavy or too difficult to remove, the business is responsible for…"

        If you speak to ACCC they would concur with this reading.

        The disagreement has come in what each party thinks is "difficult to remove item." The buyer thought it was and the seller initially did not. But they have come around.

      I didn't but I'll look into this.

      • I understood the OP was trying to arrange return shipping at no Nett Cost or inconvenience.

        Clearly it is a mechanism where qualified PayPal purchases can be returned via a Courier that the OP would have to book and pay for and then claim reimbursement.

      Read my above post linking to the ACCC on ‘returns, refunds and repair’ for why he is not according to the consumer law being unreasonable.

          it appears that its 24 hours from 5th previous neg. It doesn't roll over at midnight as I had originally expected.

          Here is a plus for calling "Mr Happy Pants", that made me chuckle.

          Lets hope the OP goes well while locked in a battle now with umart to get the item picked up.

          Yes you're correct, umart should pick it up by ACCC at the end of the day. But I'm a more flexible type of person and would just take it to the post office to be done with the matter, rather than dragging the issue out for weeks on end and all the added stress of doing it. They are still paying for return postage, so no real loss to me other than 15 mins in time to take it to the PO, vs hours of emails back and forward.

          Each to their own though.

      you both are being a bit unreasonable. You don't have a car, thats not there issue they have offered to pay for return postage, you just need to take it to a post office!

      Just checking that you understand, this was an error entirely on the supplier, why do you think it's reasonable to expect the supplier to send a courier to pick it up?
