Lease Transfer Issues with Estate Agent

hi guys

i have an issue with my real estate which i would like to your suggestions

I leased a house in NSW in in January 2018 and because of my job issues i had to leave the house in a month so i found someone who was happy to take over lease and he signed and took over the lease on agreed day which was 25 of February 2018 and i had vacated the property and cleaned and paid the rent till new tenant take over and some lease transfer fees as well and left on 22nd of February

The new tenant had some argument very next with real estate for some condition and asked to either fix it or confirm that tenant wont be responsible for some damage which was already there before me or him occupying the property( which he was smart and right too and i didn't knew that as well ) and they didn't agree with him and he broke the lease and he paid lease break fees and signed off everything

  1. now when i called the real estate they said once the new tenant takes over the lease i get my bond back which did not happen
  2. I called again and they told me that new tenant has left a chair in the house either you come and remove it or we bring tradie who will charge some money and i sent my friend and got it removed
  3. Next call i got yesterday means 12 days after the lease transfer that the house is not clean and you have left carpet dirty for which i asked to provide me proofs which they haven't and again i asked my friend to see if i left anything dirty he went again and took keys from there and double checked everything and he told me everything is ok but i was told it needs to be professionally cleaned and to avoid hassles i said ok thats fine and quote me the cost for that cost is quoted to me today which is over $450 for a 2 bedroom small apartment which me and my wife used only for a month and tried our best to keep clean and left it clean for sure

my question is following

is it worth to dispute it as i dont think its fair and if yes then how?
do i have any liability after transferring the lease to someone and doing everything fairly and even for lease break i was informed by new tenant not the real estate
what are my rights in this situation :( i dont mind paying cleaning fees but when i know even if you clean it professionally it wont cost over 200 for this small apartment and i have done professional cleaning myself and know that its way too much need advise please

    why are you still communicating with the rea when you no longer have contract?

    start the process of claiming the bond back.

    • because they have not refunded my bond

        dont talk to them. their job is to not give you your bond back. they'll find any excuse under the sun to avoid refunding the bond.

          Call them - am not sure why your bond hasnt been released yet.

          Certainly put in a bad review after this is sorted for you

          That is the reason they have given me before was chair and now its cleaning total bond is 640 and cleaning cost is 390 so in the end i am left with 250 only and even for the 250 i am not sure they will refund or not

          But why it is even your issue given you were already out of lease as the new guy took over the lease ! So I think u shud get your full $640 back

          This is what i think too because i transferred the lease i feel they are trying to rip me off nothing else i have submitted the refund claim if they deny it most probably i would escalate as it seems unfair when you already handed everything and someone else took lease and break it

    They are going to bill you for getting a tradie to take a chair that was left by their recent tenant?

    Ask how much will the tradie cost and how much is the amount they're willing or deem reasonable to contract the tradie for. Don't at any point accept that the chair is your responsibility.

    Remove said chair and invoice the REA the amount. after all, they did say it is a a reasonable amount and you did get the job done for them.

    • I already got it removed honestly i didnt wanted to go through any hassles and just wanted to fulfill requirements but they have started to increase day by day and the new lease owner broke the lease not myself for which they informed me after 10 days of start of new lease

    I left a house extremely clean when I moved from NSW to QLD. the agent rang me and said there was a cobweb in the corner of one of the bedrooms and they would have to deduct $65 to get a cleaner in to remove the cobweb.

    get the (profanity) broom from the laundry and remove it.

    that sort of laziness, and pettiness gets on my nerves (if you hadn''t noticed)

  • You arranged the new lessee , what happens after that is between them and the real estate, it has nothing to do with you.

    • Thats why i transferred the lease and they have already received lease break fee for which i am notified after one week and they are asking me that new lease owner stayed one day only

      • Don’t name and shame the rea. Provide the rea a link to this thread and give them the opportunity to respond to your concerns.

  • It sounds like your agent is taking advantage of your limited knowledge of your rights as a tenant. You should call the Tenant's Union ASAP.

    You might want to look into transferring a lease (also known as assigning a lease) versus breaking a lease. Were you off the lease when you left or were you technically sharing the lease with this new person?

    The agents accepted the new tenant so it's not your responsibility to pay for any problems they caused.
