Any Advice When eBay Not Refunding an Item Not Delivered

I recently bought a used iPad from eBay for my 5 yr old. Seller posts the item as next day delivery no signature required article.
Auspost messed up everything and didn't deliver to my address but marked as delivered.

Contacted eBay, Seller and Auspost. Auspost advised they can't do further investigation as the item is sent as, no signature required article.
Contacted Seller and they said they can't help and didn't even bother contacting Auspost.
Contacted eBay and they said as the item is marked as delivered, they can't help.

First time happening and lost all confidence with eBay. Their Money back guarantee is a crap.

Anyone experienced this before?. Any advice is welcome.

    paid by paypal ? you should file paypal claim instead of ebay.

    • Couldnt find a way in PayPal.It says to contact eBay resolution center

    • Found the way to dispute in PayPal.
      No idea why ebay is not taking any responsibility. Not a safe way to shop

        eBay aren’t taking responsibly because it isn’t their problem. eBay is the platform… When will people get that?
        The seller should have added signature on delivery for an extra $3 or you should’ve selected that option.

        Leave the seller bad feedback for not being helpful. As a seller I’ve opened cases before. Unfortunately Auspost doesn’t like to do their job and help.

        Next time get signature on delivery for a expensive purchase and perhaps get it delivered to a parcel locker.

          I remember they was option to disable safe drop either when you buying it or when it in transit?

    Unless the tracking shows it was delivered to the wrong address/post code, you'l most likely get the same result as ebay.

    Paypal only ensures that the seller sends the parcel, which the seller has done. For an Item not received dispute, paypal will just ask the seller for proof of postage- tracking is proof that it was delivered.

    As far as seller is concerned, their job is done. Item was delivered, for all the seller knows, you could be lying or your neighbour stole your parcel- thats not their problem.

    You might as well give the Paypal route a go, but from experience, there's a high chance you'll lose. You could try calling Aust Post again and hope you get someone else. The only thing left is a chargeback, but if the evidence is against you…

    Also, just FYI, there's a difference between 'advice' and 'advise'.

    For all intents and purposes all the evidence shows the item was posted and delivered correctly. It comes down to your word against documented delivery.
    In all fairness how is the seller or EBay not to know you are trying to scam the system?
    Don't like your chances of success.

    Next time use a parcel locker, impossible for items to go missing then, and you get a text message when they arrive so you can collect right away.
    If you used a credit card through PayPal instead of a bank account you have a small chance of getting a chargeback but if I were the bank I wouldn't grant it - it looks like the item was delivered.

    As an afterthought, it is conceivable the seller addressed the package to the incorrect address? AusPost would naturally have delivered to that address.
    Have you asked the seller for evidence of the actual address the package was addressed to (not just evidence of the package being posted)?

  • I would create a return case/dispute case in Ebay and explaining the situations. If the seller doesn't reply or doesn't resolve the issue you an ask ebay to set in and 99% of the time it finishes in your offer. Refund.

    Just make sure you provide details information about the problem. Photo/screenshot from Australia Post/Seller will help.

    Did you buy from like random ebay seller? If so it kinda hard unless ebay sets in, usually actual ebay seller will try to keep you happy and usually refund them self or when you open a case as case resolve against them by ebay will leave a delt in their seller score.

    Also for expensive item you should have signature/no safe drop/Parcel Locker or cameras at front door to show it was not delivered or someone have taken it like neighbor/theft.

    • The item was delivered to the right suburb so that's not going to work unless the seller doesn't notice the emails from ebay

      • Was the item delivered via safe drop? If so they still a possibility. You still can open a case with paypal if ebay case yours or from CC.

        • The tracking still shows as delivered either way

        • Its not safe drop. Auspost says the seller ships the item as no signature required article.
          It is clearly Auspost issue as I have seen incorrect mails in my mail box. If it is addressed to my neighbors I go and give it them, can't expect the same from others.

  • I am planning to do a proper complaint in Consumer Affairs Victoria. I don't hope I will get back what I lost but at least if I can make Auspost or eBay to be cautious in handling customers. No proper response from Auspost

  • This is my experience last year
    All i can say to u is, u wont achieve anything with aupost, they are the worst disgusting company that make fake evidence.

    Last year i lost 3 parecels from aupost, over $4000. It was sent through ems, therefore they have trackinga and require signature on delivery. However, i receive none of them, but the tracking show they were delivered.
    I contacted seller and aupost straight away, seller said they cannot help i need to contact aupost, aupost says they cannot help i need to ask seller to contact their postoffice. After bit of fight, aupost ask my signature, they want to compare it. I knew its fake, they have nothing to compare cos no one signed it off. I still gave to them. They back to me saying the driver said they were delivered and signed, i asked aupost to give me the signature copy, they couldnt give me any.

    Sl next step i contacted paypal, paypal is a bit hit and miss, out of 3 parcels, they refunded one to me, seller was rage with the conclusion. The other 2 parcels, paypal said to me the tracking shows delivered so i cannot get any refund.

    I then contacted my credit card company, gave them a bit of pressure, i said to them if they cannot solve my dispute, i wont use them anymore ( my monthly credit card spent is over 25000aud, so i think i am their value customer) . One month later, i recieve full amount of refund from my credit card company. So in conclusion, i think its always safer to use credit card to pay ur purchase, dont use paypal balance, at least this grants you double chances of dispute)

    • Ebay protects seller as long as there's tracking number, no need to have signature. Even if they do, usually those lazy postmen or courier driver still just leave them in front of ur door step and signed themselves.

  • Shouldn't the seller be talking to Australia Post about your item? They contracted them to deliver it, all you were doing is waiting to receive it. Or has ebay changed things around now so its all the buyers problem?

    I'm glad that the postmen and couriers around my area are really good, and don't do the dodgy things that I've heard other people say happen.

    Regardless of outcome, next time insist on insurance and signature on delivery. Hope it all works out.

      It is a sellers problem…. Until tracking is marked as "delivered". For all the seller knows, op could be lying or his neighbour stole his parcel- neither is the sellers problem.

      Not sure if insurance would change anything in this scenario, evidence ie. Tracking, still show delivered.

    I have contacted postal ombudsman and they have contacted Austpost. Now Auspost refunded the amount I paid
