How to Claim Compensation for Being Stuffed-around?

We recently bought a computer from a big company, cant mention name as it is still ongoing. It cost over $1k and we have been on the case for more than a month! The experience is so bad that although I do empatise with businesses, but we feel like we should not let them go this time.

First did online chat with Sales, and committed to buy the item straightaway. Happily paid in full after 20-minutes chat, and was told further emails will come. (At this point there was no doubt in my head that they do have stock. Correct?)

Within a few hours their email arrived which said item will be delivered 3-April. That's 12 days from date of payment, so not bad.

3-April came and gone, no sign of the item so we emailed the Sales Rep. Took a few emails to get replies: from Customer Service: emailed and asked silly questions like "show us the proof of payment, your credit card statement". We were furious because Order Number and emails link was already provided. So we emailed back all the chat logs, bank payment ect……

Weekends came and gone and finally on 17-April, the Sales Rep rang and mumbled something like "end-of-line"……. I had to cut short and said are you out-of-stock, to which he mumbled positive, and went on and asked me whether I have any other models that I wanted….. Needless to say I was very furious by that stage. For weeks they have been ignoring us, not responding to emails and now this? Long story short they agreed to give full refund. Some of the emails have names of the Supervisors.

We feel really gutted that a big company like this can just ignored us well past the expected delivery date. I can handled slow delivery, or even cancellation. But being shafted like this, and having to talk to different people, providing proof and all that is totally unacceptable. I have searched and it seems submitting complaints to the higher level is not all that easy…… So hopefully the ever-resourceful OzBargainers can guide me to the right direction.

    It is a long time to wait but what else would you get besides the refund? Maybe a discount on a next sale? It sounds like you won't be purchasing from there anyway.

    Prepare to be blasted by the oz bargain community for asking compensation lol.

      His 1k being taken by the company for 26 days roughly. Plus the time he spent trying to sort out the issue repeatedly.

    You are not going to get compensation and every second you spend thinking about how to get compensation, rather than take the refund and finding the next best purchase, is wasted time.

    2. How much are you willing to pay to get that compensation? (Factor in your time as well)

      So what's the end game? Make some poor minimum wage employee have to listen to your grievances and force them to be apologetic to placate you, which they have already done by the sounds of things? You won't be teaching the company a lesson - just teaching the employee a lesson in how to deal with difficult people.

      You have already knocked back their suggestion of another model and getting a possible discount on that.

      You have no consumer rights here. It's over and done. What a tough life you have if this is the type of thing that saddens you. Stop spending time thinking about it and go have those fine dining experiences you talked of instead.

      thats the consequences…
      anything else is just you thinking you're more important to them than you are, or that consumer rights provide compensation. If they refund you, they've ticked the ACCC boxes.

    Dedicated computer stores tend to be some of the worst with communications, in my experience.

    Recently, some friends and I (total 6 of us) wanted to build some mid/mid-high tier gaming desktops. I made myself responsible for ordering the parts required, and whilst some items were relatively easy to purchase (SSD, cases, CPU's, RAM), I had an extremely difficult time sourcing PSU's and GPU's. Granted, the whole Crypto mining boom has caused a shortage for those parts, but that shouldn't account for having SEVEN orders cancelled and refunded (often with 3-5 day delays, and some of which required prompting to actually get them to realise they didn't have stock) from different retailers, all of which stated that they had everything in stock. After those seven cancelled orders, the required components came from four different retail stores (including some partially cancelled orders due to insufficient quantities). I understand that 6 GPU's and 6 PSU's are a big ask in this environment, but such inconsistent inventory management and poor communication from several different retailers is very disappointing.

    • This happens often. Store lists there being stock, but in reality it's stock at their mutual supplier, which ends up in a competition on which retailer ends up getting the stock.

    Some people here just give the most helpful of advice… Well I'm going against grain so bring on the downvotes peeps!

    It is very well possible to get compensation if it's a big company. You just got to call them up and negotiate well. It'll probably be money to use at their store though.

  • The best compensation you can reap is informing others to stay clear of this Company…do it legally and reversible by leaving reviews…this WARNS everybody, gives the Company a fair indication of their performance and you can always post a Follow up review and again INFORM everybody…an alternative PC at the right price may have been the 'compensation' you were seeking…you chose to not go down that path….your decision. Leave the reviews, let them know and see what happens.
