OzBargain Expert Review! - Another Parking Ticket Discussion

Hello all Experts of Ozbargain community,

I have seen lots of discussion re traffic rules and parking so thought to ask experts opinion on one more issue.

Is it illegal/council can fine if you park on dead end of the street? There is no 'no parking' sign. There is a flood creek after the dead-end.

I have been fined once and I have asked for a review but don't know what will come out.

Since I got fined, I have been monitoring it regularly and at least two days of the week there are parking tickets on cars. Obviously, as it is near to railway station, people who got burned will stop parking but others who are not aware about it will keep parking unless they find out.

Edit:

On the same topic, I always see cars parked next to the railway track when there is no sign, no yellow line.

I have seen it at many places and throughout the different suburbs. Is it also not allowed? I have no personal experience so can't comment but eager to see your views.

    I think it's a combination of the following.

    1) Should it be illegal?

    Yes. What if, for whatever reason, there needs to be access to whatever is behind that dead end. For example, it looks like there's pipes back there - what if they need to be accessed. How about that house with the driveway there on the right, it looks awfully close to that car parked - it makes it harder for them to reverse out of their driveway. In general, like parking within a certain distance of an intersection, this should not be legal.

    2) Should it be common sense (i.e. should people know it's not legal)?

    Yes. I think that most people who park there are being opportunistic - surely they don't actually think that they can park there, but rather, they park there because they don't think anyone would bother to catch them at the dead end of some street. I'd be surprised if the drivers actually (genuinely, from the bottom of their heart) thought that it'd be okay to park there.

    3) Is it the council trying to milk fines?

    Yes, if it is an issue, they should just put up signs. So I do think that the council is milking this one. However, that said, the buck stops with the driver - milking or not, if you allow yourself to be milked, then it's your own fault at the end of the day.

    • Genuinely, I never though that I was wrong parking there as there was no sign. However, I am not claiming that I am right and council is wrong.

        • It’s the end of the road tho, not the middle of it. It’s like saying you can’t park in a cul de sac with no signs…

          Ahh just saw the pic, maybe they would be alright if they parked horizontally along the edge of the end of the road.

  • Are there other parking type signs in the street prior to the dead end?

    • If I remembered correctly, there is no sign. I'll check next week and report back.

    I wonder if the black toyota is illegally parked? If there are no signs on the side of the road to say otherwise, I would assume that's legal?

    The other two are parked in the middle of the road so I can understand why they would get a fine.

      When I was monitoring after I got fined, cars next to the curbs were not fined i.e. - Black Toyota

      Only cars in the middle were fined.

        I would imagine then the fines are for not parking as close as practical to the curb in the direction of travel which you are required to do.

    I'm honestly not sure OP, having said that the lawns are being kept in great shape.

      • If I wanted to be sure that I was on solid ground, I would check the local by-laws for the particular council. Don’t check at council’s offices. Try online, or if you’re having difficulty finding the information, ask your local library.

        Certain councils with which I have had dealings (in NSW) don’t give all the available information when you ask for a review, and/or they try and bully you into complying with their ‘wishes’. I asked for a review and was told that there was a good chance that it would be granted. What the council officer didn’t say was that the review was going back to the person who had first issued the fine! Some review.

    Are you the Honda?

    That is parked illegally.

    The offence should have been "Not park parallel in the direction of travel".

    The ute at a pinch, the Toyota would be ok.

      That sounds about right. Both the Ute and the Honda are parked in the middle road.

    • Many councils in Melbourne have a law that prohibits "parking too far from the kerb", this case would fall under that category, and strangely the same law is used to fine vehicles parked the wrong way, (rather than your example which would make far more sense). If there's no kerb/gutter, which is a common scenario in out suburban/rural areas, then perhaps they couldn't apply that rule, I wonder.

  • I always park by the kerb unless it's in a rural area. Just to be safe from greedy councils.

    • That covers every council in the country!

  • Overseas tourists/ first timers especially from the UK, get done all the time for not park in the direction of travel.

    They only do it once, $200 makes you learn pretty quick.
