Pricing Error - What to Do if Item Has Been Sent/Opened/consumed

Hello

Purchased few item online (supplements stuff) after price hipster listed them as reduced price. So I ordered few items, paid, item sent and delivered. I even have opened and took one serve of supplement. A day later, the customer rep rang me to notify me that they had "pricing error" on the stuff that I ordered (including the one that I have opened/consumed), and asking to me to pay the difference for the "correct price".

What's my option here?

    It is their fault. How much is the difference.

    I would ignore the request, but you probably won't be able to buy any more from that store.

    • Open another accpunt is easy if you want to buy again. I doubted OP will order with the new price

    ^ That's the right response to the customer rep on the phone. You have no legal obligations here - the contract's complete. They took your money, however much they asked for, and send you the goods. It's a done deal. They can go take a hike.

    They offered the product for sale.
    You purchased it.
    They delivered it.

    End of story, tell them to suck eggs.
    Do you think they'd give you a refund if they charged you too much?

    They didn’t have to sell it to you at that price. If they have made a pricing error can tell you of their mistake before processing your order and offer you the choice of paying the right price or getting a refund. https://www.consumer.vic.gov.au/products-and-services/busine…

    But they didn’t do that, they took your money and sent you the product. Too late for them to ask for more money now, the sale is complete. Ignore them, or if they keep hassling you, tell them you will file a complaint with Consumer Affairs or the equivalent body in your state – Dept of Fair Trading etc

    Tell them you won't pay the difference but if they want the items back they can organise a courier to pick it up from you at a time of your choosing. Causly remark that some has already been consumed.

    If they push the extra payment issue then tell them it sounds a lot like bait and switch.

    So what was the price difference?
    I can't imagine a business would risk losing customers by calling them if it was "just a few dollars".

    Sorry, pricing is accepted and transaction completed basically once they shipped the item.

    What's my option here?

    Kindly remind them by law they had the option to cancel and refund the transaction at any time BEFORE shipping, but as they have shipped and delivered the goods, this is accepted as a completed transaction.

    They need to wear this loss and learn for next time.

  • There was an absolute contract of sale made between you and the retailer. The retailer accepted your payment and shipped it. They can't void the contract now by claiming it was a mistake.

    Block them if they call you again, and enjoy your supplements.

    If you wanted to do the moral thing then ask for a refund for the ones you didn’t consume, and as suggested previously.. they can send someone to pick the other product up from you.

    You don’t need to pay them for their own stuff up.

    • Don't return the supplement back to the company. You may have to pay full price for the ones you have consumed. Just ignore the rep. You will be fine.

      How embarrassing to call and ask for more money after shipment.

  • I will not pay, it is their own fault, why send out goods when price is incorrect. If seller don't check, they have to cop the costs.

    Have a look at the prices. 88% off protein. $4.70 for 400g. There were others too that were 80%+ off

          …and if it's not snake oil, then what's with all the other users complaining about it then? I think I remember JV at one point arguing this exact point across somewhere on another forum thread/deal….and I think there was a couple of the others too who sees this as waste of money….

          @Zachary:

          I think the theory is that getting your protein up may not be practical just through food sources, so protein powder is a nice way to supplement it.

          In saying that, as a beginner, it's probably irrelevant.

  • Order/paid. Item shipped. They completed the sale.

    I believe under fair trading with a price error buisness can contact you and offer a refund or if you want to go ahead with the sale at the corrected price before shipping.
