[VIC] As Landlord, What Documents Can I Request from Agent?

Hi all

I wanted to ask what are the documents the landlord is legally entitled to request if the property is leased out through an agent.

1) Of course there would be the actual agreement signed between the two parties, but as a current renter myself - I wanted to ask if the landlord is allowed to request personal information of the tenant eg employment history, bank statement or any other document a renter would be expected to submit.

2) As an owner, my current agent has not sent any document to me to approve of prior to leasing it out to the incoming tenants - do I have the power to vote against this decision?

    Logically, these are questions you should have asked your agent at the outset? WHY DIDN'T YOU?

    agent told me landlord needed my bank statements for last 12 months, payslips last 6 months, certified copy of drivers license, stat dec stating I do not have a criminal record, do not own any pets and will not own any pets for as long as lease continues. there was something else too maybe trade certificate and uni degree copies too. anyway it was a hassle.

      You left out the DNA test results. Agent needs this too.

      Surprised they haven't asked your "length" as well…..

      The requests would be coming from the property owner. I would not want to rent that place!

  • I'm pretty sure you can ask for ANYTHING you wish within the scope of the assessment of whether the potential tenants have the ability to pay your requested rent, plus other stat decs and the contract itself.

    As a tenant once upon a time, I was asked for payslips (2 months of), references, letter of employment, bond, drivers license (VIC).

  • I run a real estate agency. It sounds like you need to change agents, you should not even be asking these questions.

    Check your Agency Agreement for any cancellation fees then give them the boot as soon as you can. I guarantee plenty of other agencies would love to have your business.

      Would you be able to refer me to any agreement in place that would tell me the rights of the landlord regarding these documents? I'd need something to back up what I'm saying.

      • what state are you in?

        every state has an Agents Act that deals with real estate agency agreements. Google that for your state and have a look at the agreements. Essentially the agent has no authority without your permission and you can cancel their management at any time. The tricky part is that a lot of agency agreements include management cancellation fees. Check the agreement that you signed with your agency, it will have everything what you have agreed to write down.
