Driving and Almost Hit a Scooter (Legal Question)

Gave my heart a shock today .. And I am happy that no one was injured. Sorry my English is not that good so please bear with me.

I stopped before turning, checked my right and left and again right and left, and there was only a scooter slowing down and flashing left light to turn into the street I was at. There was no cars behind the scooter and he was around ~20m-ish from me. Because of the things I can observe, I turned my head and looked left again to make sure there were no cars coming.

Then I pressed my accelerator slowly to turn right into the lane.

THEN as I was turning, the scooter suddenly sped up and went straight so I almost HIT him!!!! Thank God I didn't!!!

Ok, so if there were to be an accident, which is horrible, but legally, whose fault would it be at?

I learnt my lesson today and it was engraved in my heart that I should wait until the scooter/ or any vehicle fully turn right before I turn even if they are flashing left and slowing down JUST INCASE they decide to speed up and go straight.

Apart from my fault or your fault jazz, I am thankful to God that no one was hurt.

Thanks for the replies! I learnt a lot!
For next time I will definitely include the mspaint. I didn't realise I could do that!
I also learnt that sometimes indicators cannot be 100% trusted.
I used mspaint and posted on Reddit because I am not sure what is the best way to do it!
If anyone could teach me the AS3000 for mspaint, that would be great.

    You would still be at fault for turning across his path no matter what his signals were indicating

    You didn't mention whether it was a 4-way intersection (where one street should have Give Way or Stop signs) or a T junction.
    Assuming it was a T junction:
    If you were on the main street (one that continues pass the junction) you had right of way and scooter must give way to you.
    If scooter was on the main street (your street was ending), you were in the wrong and pulled out in front of them, which was a very dangerous thing to do.

    Edit: include a MS paint next time.

  • Even if the scooter was slowing down to turn, at just 20km/h he will cover 20m in about 4 seconds, not enough time to slowly accelerate in front of him.

  • You said you looked left again after seeing the scooter flashing right light to turn into the street you were at.

    Did you mean to say the scooter was flashing left light? and the scooter was coming from your right?

    This will be a lot clearer if you can draw us a diagram.

  • OP was making a turn onto a street. The scooter was oncoming but indicating it was turning into OP street leaving room for him to turn. Scooter didn't turn and OP almost collected it.

    OP you are at fault. Never trust an indicator, people forget they are on or change their mind.

    Many scooters don’t make a sound or indication to the rider that they’re actually on so it’s very common to forget to turn them off. When passing the learners course in vic they actually check you remember to turn them off after turning.

    So basically, always watch what those riding scooters and motorbikes do, don’t trust their indicators.

    Definitely your fault. I remember my instructor advising to wait until you see the vehicle turn into the street before moving as they could have not realised the indicator was on.

    Typical:

    "Signal on"—> "just kidding!" (Proceeds to drive 500kms w/signal on).

    "Actually turning" —> no signal, EVER.
