Ourdeal - Reps lie to get you to buy !!!

Just a warning that these Reps lie in the forums to get you to buy the deal…

This was advertised as $15 value for only $3 and the Rep specifically said it includes free coffee (thus $15 value)

However, the facility does not honor this promise and you have to pay for your coffee (cost for 2 coffees $7.60)

  • I was also refused coffee, although it didn't really bother me too much as that was not why we went - it is still a pretty good deal and it is a nice new center that the kids loved.

    (We did make up for it by taking all our own food and drink)

    • it's still a good deal… but the Rep confirmed that it was included… I presume they checked with the facility, so they blatantly lied so they could sell more coupons…

      it's also awkward for both the customer and the staff when you enter and ask for your coffee !!!

  • next time we go there with our other 2 vouchers, will definitely take our own food and drink and if they say anything, i'll tell them they breached the contract terms of the voucher i purchased, so i don't have to abide by their rules…

    rep says one thing, provider says another… so of course the only conclusion is that the rep lied?

    nice logic… maybe the rep did lie, or maybe the provider reneged on the agreement, or maybe there was some "communication breakdown" along the way or other "honest mistake".

    in any case, and whatever the reason behind it, the end result to the consumer is another sour deals experience and none of the parties involved win.

      "Hi! Yes, the deal includes free coffee. You just have to ask at the counter when you're presenting the voucher. Enjoy!"

      you buy, based on that claim, and then you turn up and are refused the free coffees, then yes, the Rep lied…

        a false statement =/= a lie; if you don't understand the distinction, please look up the definition of 'lie'.

        you stress so much that the rep lied, but you have not shown that s/he did. in the absence of any evidence that the rep did in fact lie (eg they knew the deal did not include free coffee, but said it did anyway), all you've shown is your sensationalism.

          My point wasn't the refund… I've already given them the voucher…

          I may or may not have purchased the original voucher because of this, i don't know…

          The main point was that people turn up expecting a free coffee, and are refused. It creates an awkward situation between both the Customer and the Staff.
          It starts off the day in a very negative way…

          I assume you either didn't ask the owner, so you lied to us, or the owner of the facility lied to you… Is that correct ???

          I believe this is the source of miscommunication?
          From OurDeal's responses, it appears that OurDeal were told by the supplier that coffee was included, but it hasn't appeared so. The supplier may have lied to OurDeal or not all staff at the supplier realised the deal offered free coffee.

          Just based on the correspondence from the OurDeal Ambassador, it really doesn't sound like they are in the wrong…

    • I've also had a very frustrating issue with OurDeal! I recently bought two vouchers for a Spa Massage, and despite the money having been transferred out of my bank account to OurDeal I have still not received either of the vouchers. I've emailed their customer support numerous times and have not heard any word back from them at all! Two of the ticket numbers I've managed to find are (#30532)(#30885). Would anyone happen to know a contact number I could reach them on by any chance please? It's so annoying when you have to sit in the dark and not know what's going on despite having paid so much money!

      • I am also looking for their phone number I can contact? because I bought a $39 restaurant voucher yesterday and still dont have the voucher in my account. The voucher was meant for my friend's birthday celebration tomorrow. I sent email to the customer support but doubt will get answer by tomorrow

  • OurDeal should be banned! their responses have been terrible in relation to Elazmo/Sydney Underworld.

    Firstly, came up with the excuse of unable to give a refund because they had already paid Elazmo/Sydney Underworld.

    Secondly, then said any time I buy a voucher, it is directly with Sydney Underworld / Elazmo.

    Absolute crap. Even a 1st semester law student doing contracts can tell you that OurDeal owes the purchaser of the voucher an obligation and is not allowed to engage in misleading and deceptive conduct.

        I found out from PADI that they have asked Elazmo/Sydney Underworld to stop advertising themselves as being PADI certified or being able to give out PADI certification.

        I wonder if anyone else has had a bad experience with Elazmo/ Sydney Underworld

    I agree with everything in the whirlpool discussion. However, consumers need to remember that sites like Scoopon, Our Deal, Star Deals, Living Social, Spreets etc…still have an obligation to you, whether they are acting as agents or not.

    A group buying website under the Australian Consumer Law and formerly the Trade Practices Act and Fair Trading Act MUST NOT engage in misleading and deceptive conduct. All of these sites make representations that:
    1) you will save a lot of money;
    2) you will be able to redeem the voucher with the 3rd (though not quality of service);
    3) you will be able to redeem the voucher in a timely manner; and
    4) sometimes represent that you are going to a reputable award winning restaurant (hence implying good quality).
    Clearly sometimes when it doesn't turn out completely different to what has been expected, the Group Buying Website may have engaged in misleading/deceptive conduct.

    It is also arguable that you have entered into an agreement with the Group Buying Website, where the Group Buying Website's obligation is to provide you with a redeemable voucher for service with a 3rd party and you pay them the $$$$.

    There are many examples of situations where A has a contract with B, where B has an obligation to ensure C performs for the benefit of A and A pays B. B may have a contract with C, where C is required to perform on behalf of B a benefit to A and B pays a little bit money to C.

    It's hard to argue around Privity of Contract, which some of these Group Buying websites do. I wonder who their legal advisers are…

    • Don't disagree with you about false and misleading conduct.

      Come to think of it there's no reason this wouldn't be a multilateral contract. There's nothing saying you can't have 3 parties as part of the contract.

  • After much correspondence and threatening to take them to the CTTT or even the Local Court Small Claims, OurDeal agreed to refund me by depositing the same amount into my bank account. Battle won.

    However for the hundreds of dissatisfied DailyDeal/Scoopon/Living Social etc purchasers, always remember that regardless of what those sites say, they have a duty to ensure that:
    1. they have sold you a redeemable voucher, and redeemable being:
    (a) redeemable in a timely manner;
    (b) honoured by the 3rd party;
    2. they need to ensure that they have not engaged in any misleading or deceptive conduct such as:
    (a) failing to tell you there are extra charges;
    (b) goods/services were as described;
    (c) goods/services were the same quality as described.
