Apartment Water Valve (Common but Service 1 Flat Only) Makes Noise - Who Pay

  • Water Supply Valve (on common property but service my flat only) makes noise
  • People above complain
  • Plumper advise the valve is functional and just put up with the noise
  • Owners Corp. have the valve replaced
  • Owners Corp. sent me the whole bill, I disagree.

Regulations: Section 49 & 129, Owner Corporation Act 2006
* My interpretation: regardless private or common, who benefits from the works pay for repair and maintenance

Contacted Consumer Affairs, told to make a formal complaint and get a lawyer.

  • Should be whole building no? Thats what your strata fees are for

  • I believe plumbing is strata responsibility, even when is inside your unit walls, unless they have adopted bylaws to exclude the plumbing form strata. Nothing outside of the walls though. If its outside your lot, also should be strata. You can take them to the tribunal, I think you can make your own submission, but not sure. It looks like you are dealing with some tough owners there. How much is the bill for if you don’t mind me asking?

    • $330, if shared among the whole building is nothing but the owners corp woman wants me to bear it all

      • maybe tell her that you are disputing the charge and are prepared to go to the tribunal. Ask for a basis in the strata management act or their bylaws for their request.

        • Have done all that before going to Consumer Affairs. Please refer to the main post for the cited Section/Clause.

  • Should be a cost borne by the Body Corporate on behalf of all owners as the problem would seem to be external of your own unit - viz on common property.
    Ask to see a copy of the Body Corporate bylaws which specifically states it is your problem.

  • cost should be borne by strata. ask for detailed response from strata manager under which bylaw you are required to pay the bill. then lodge complaint.
