I Only Have Third Party Car Insurance but Got Hit Today (Not My Fault)

Long story short, I stopped at a traffic light and 4 seconds later the car behind rear me. I have got a dash cam but only at the front.

He just so happen to not have his driver's licence on him but he gave me his address, Date of Birth and phone number.

How do I get claims for this?

        • Are you sure it was nrma CTP? I haven’t seen a PDS for CTP for a long time, but don’t know of any that would chase for property damage. I do recall they used to offer driver protection on some CTP policies.

          • @Euphemistic: 100% sure. It happened recently. The guy on the phone from NRMA sent a letter to the at-fault drivers' address.

        • Strange . My case with AAMI was entirely different from yours.After knowing that I was on their third party insurance cover , they just sided me off and won’t border to help me at all. Obviously NRMA is very much better in serving their customers. Credits go to NRMA.

    Ceebs reading all the comments. Call up your insurance company and lodge a claim. They dont need licence no. Well for aami they didnt. And they will deal with the rest

    Your TP pays to other party involved in a collision that's caused by you. No chance they will pay.

    If not at fault, always try to claim from their TP first. For this, you need him to start a claim with his TP insurer and then provide you the claim number. If the damage is little, he may want to directly pay for your repair. Go to your trusted repairer with him.

    How bad is the damage? Did he look like he could afford the cost of repair?

      Some third party has uninsured motorist benifits.

    This might be a similar situation.
    A truck (while I was stopped at a red light) touched my rear bumper and left a dent. I got out and asked the driver (old guy) for details; he was really rude and wouldnt give me anything. So I took a picture of his rego and he literally just drove off. I called the police and then went to a police station with the rego and explained them the situation. A few hours later I got a call from the police offer with the details of the company that the truck was registered to. I've never been in this situation so I contacted Vallar (a company that deals with 3rd party insurance cases) and give them the details that I had.
    After 3 weeks, they got back to me saying that the truck company is not accepting their fault. I don't know what else to do because I don't have any dash cam. Just a friend who was sitting with me - declared him as a witness on Vallar claim form. Would love anyone's suggestion on how to proceed forward with this as its already been about a month now. I only have 3rd party insurance btw.

      Send a letter of demand to the truck company and ask them to identify the driver and lodge from small claim. You will need to at least get few quotes and send with your letter of demand

    Aren't you supposed to call the police after an accident to get a police report to prevent these sorts of things from happening?

      Not necessarily. In fact there are some conditions where you are asked not to call them. Ie low value damage, no injuries etc. I’m not going to look them up.

      I’d rather the police were doing more important things than attending every minor crash.

    • It varies by state. In Queensland I don't think the police are interested unless someone is injured, or you want to lodge a complaint against the other driver. If it's just a run of the mill fender bender then they don't care.

    • They don't have the resources to attend every accident.

      Only call them if someone is injured or if the other driver is drunk or has otherwise broken the law.

    • Recently happened with us. Officer on phone said it was a minor accident and they no longer come out to take a report (NSW).

      Luckily a cop drove by as a coincidence and I waved them down. They asked initial statements from both of us. I asked. the cop his name and station.

      Two months later the insurance company said they're story wasnt matching mine ( the guy hit me at a set of lights..pretty clear cut).

      I referred them to the officer who confirmed said driver had said he hit me stationary at lights.

      If the cop didn't take a report then and there at the scene Id be (profanity). If I ever get hit again, I'm almost tempted to say the opposing driver won't provide me their details just so I can have a police officer attend and justice can ensue.what a flawed systen this bs has become.

    Good chance he didn't even have a licence.
    I would have thought that generally, one should contact police if either party in car accident does not have an offical photo ID such as drivers licence to prove they are who they say they are. This, IMO, should be considered on a case by case basis. Ie. The cost of damage involved (because you are risking that by not getting a proper ID of the other person at fault), also I would consider how genuine and honest the other party behaves.

    Most insurance companies seem to cover an amount (mine is up to $5k) for customers who have only 3rd party vehicle insurance, but then are in an accident where they aren't at fault. Insurance agent told me that they will cover it, then they chase up the at fault party for the money anyway.

  • I would have called the police. You can't verify the details he gave you (except his phone no) without his license.

    The police would do worse things to him. At this stage he would probably beg you not to and offer you something.. money or whatever, to not call the cops.

    Did he have no other ID on him?

  • UPDATE: No i can't get the guy (duh) and also the police near our place did not help at all
    RACV is accepting my clam due to the guy at fault provide fake details and they couldn't reach him aswell.

    i.e. I m (profanity) lucky and would tots just get comprehensive from now on

  • Sadly the whole insurance system is shambles in Australia. The government recently spent a lot of money on a royal commission into insurance to make sure companies are being fair. That's all well and fine but the real problem is with dodgy drivers on the road causing accidents and getting away with it on account of their deadbeat status.

    Way too many drivers are welfare bludgers who are usually drunk or high. Obviously they have no insurance so if they cause a crash they just walk away from it. Good luck taking them to court - they've got no money anyway.

    Comprehensive insurance should be compulsory for people under a certain wage or for those on welfare. If they can pay for CTP they can pay for property insurance too or just don't drive. People with no money obviously have no job so the world ain't gonna end if they can't drive.
