Best Friend Stole Car and Went on Joyrides Stealing Fuel and Thrashing The Car

Long story short best friend of 25 years was given car to do mechanical repairs and some other audio upgrades in his garage and a workshop where he does work with his family friends. While my brother was overseas the friend stole fuel from multiple stations, got the car impounded 6 am in the middle of Flinders Street, used the toll services all over Melbourne, got a speeding fine, and who knows what else is going to be coming in the mail.

It's my brother's car and he has A1 comprehensive car insurance with RACV. The friend is now a full time junkie as I've been told and his brother told me the car was leaking full oil on his driveway. The car was most likely used for drug runs, fraudulent activities and who knows what else that was done to it. The car was eventually reported stolen and the detective working the case thinks the car isn't stolen because it's apparently at the workshop.

This situation has left our whole family devastated as the car was looked after almost brand new, has $10,000 worth of upgrades, so lots of time/love/effort went into modding up the car for some idiot to ruin all that in a couple month period. Car is a FG XR6 Turbo with a sunroof, full cream leather interior, full engine mods and tune. All its life the car has had BP Ultimate 98 put in and the friend stole fuel putting in the incorrect fuel that it wasn't tuned for which is Caltex and Shell.

How can a car get taken out of impound without the proof of ownership details? Just need some advice as my brother does not have a car to get around in for the past 3 weeks. What are everyone's thoughts?

      I'm sure there's peddlers and distributors who want their cut first. If you take any money from OP, you're essentially taking from drug dealers. They'll instead collect from you.

    The whole situation really stinks.

    Begin with stat. dec of when car in care of the culprit (I can’t write friend or best friend because no friend pulls this kind of crap).

    Flight details may need to be provided to prove location of brother and therefore lack of knowledge of culprit’s intents.

    Insurance probably isn’t going to pay up as your brother chose this person to care for his car.

    Legal advice is probably needed re: insurance as really this is a big mess.

    While this person is doing drugs, your family needs to rethink the trust they would ordinarily place in this person. The relationship MAY be able to be repaired at a later time.

    But in all honestly your probably f**ked up shit creek police wont help you, this junkie wont pay you back…if you havent gone to the police i'd go to them say it was stolen try do an insurance job OR if you get the car back i'd find a way to write it off might get some money back….. essentially this is fraud but the police are so useless these days it is pretty much the only way you get some coin back.

    If you are too honest for this then cut your losses - next time you want repairs go to a proper mechanic

    OP, if I was in your brother's shoes, I would cut my losses, sell the car, sever all ties with that friend and move on with my life.

    Edit : As for the fines, nominate the mate as driver, which may or may not work, depending on whether you can prove he was the one driving the car at the time or not.

    • Since OP's brother was overseas, he should be able to use his passport and other travel documents to satisfy the police that he was not the driver.

    I'm a little confused. Your brother essentially took his car to the mechanic. The mechanic took the car and used it to commit crimes, and is on CCTV committing these crimes. This isn't a borrowed car, this is a car left at a mechanics for upgrades no? Why have you not rung the police and asked them to charge this guy for theft?

  • Does the "friend" who stole the car work for an established mechanic business?

    Can you chase after the business instead for compensation for what their employee did.

    They will more likely have money/insurance and there is more chance of getting it out of them than the "friend".

  • Bit of an update, the detective says it's a civil matter and not classified as stolen for whatever stupid reason! How can I use the police report to go to court and sue for damages? Now the workshop wants storages fees to give back the car after everything the car has been through, so no help from insurance, police or the workshop. How can we get compensation out of the criminal? There's fines and various things still not fixed up as well. Disaster situation, I'm going to legal aid now and seeing what needs to happen from here on out. Anyone else been in a similar situation with some advice. No way in hell can we accept a car back that's been used and abused and then have to pay money to even get it back.

  • Spoke to a criminal lawyer and she said it is indeed theft of vehicle as illegal unauthorised activities happened without permission which was out of our control, she said Police are lazy and don't want to do the work!

      Technically a crime might've been committed but your brother handed over the car willingly and the car is (effectively) returned. It'd be a bad use of police resources to try and prosecute.

          And you get a lawyer if you want to sue him, but he's a junkie. If he has nothing, be can't give you nothing.

      Theft is not inappropriate use without permission.

      Basic definition of theft
      (1) A person steals if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.
      - CRIMES ACT 1958 - SECT 72

      (Second definition is irrelevant to this discussion.)

      The "friend" did not dishonestly appropriate the car. The friend cannot be proven to have the intention of permanently depriving you of the car.

      Get a better lawyer.
