No Stopping Parking Fine - Need Advice

Hi Fellow OzB's.

Need some advice on a recent parking fine that I received from the council.

There is an area near the station that has parking allowed from 9 AM on wards. I was recently given an infringement notice at 8.58 AM as of their timing is noted. To my knowledge, I parked my car exactly at 9 AM as per the time in my car and watch - which must had been different by two minutes to what the council noted.

Is there anything that I can do to challenge this decision?

Update : Apparently they took photos of the car and me getting out of the car. But the photos were taken from a car in side lane and must have been taken while it was being driven. Photos have a time stamp of 8.58. And to my knowledge, it usually gets the same time as the device.

    ring the council and complain, that is utterly pathetic IMHO

  • If you take it to court, you may have a case. But it will cost a day off work may be lawyer fee.

    • make use of the duty solicitor. I have cases like this where the judge just dismisses the case outright as the parking nazis were being pedantic. But try complaining to the council first.

      • What do you propose OP's defence should be?

        "My watch and car clock said 9am so that trumps the inspector's time?"

        or are you suggesting OP just go in and plead forgiveness and hope for a lesser/no fine?

          Nope I'm suggesting he calls them out of their '2 minute' BS. Pretty sure any judge with half a brain would allow for a 2 minute discrepancy. Finding a judge with half a brain these days is another matter altogether.

    Ask for a review. If they reject your review go to court. They will most likely withdraw before the court date.

  • Not sure where you live, and if this counts, but in NSW I think there is a 10 minute grace period as per: https://www.revenue.nsw.gov.au/news-media-releases/ten-minut…

    • 10 minute grace period applies to metered parking where a ticket machine is in use for parking of 1 hour or more.
      If OP can afford the time off, and doesn’t have a poor infringement history, SDRO (now RevenueNSW) would likely cancel PIN and give a warning in lieu.

    Simple - Tell them your preparing for an appeal and your lawyer has ask for photo or evidence and i'm 99% you will get off as they wont even want to deal with it.

    Did they ticket you as soon as you got out of your car or were you parked there a while before the 8:58 ticket?

      My thoughts exactly.

    • No, I reached at 9 and got out almost right after. Apparently they have taken my picture as I was getting out. From the pics, it seems they were taken from inside another car in the other lane (beside the parking lane). Wondering who would take pics while driving ? You certainly can’t stop in the middle of the road and take pics.

      • In that case have the charged for dangerous driving. If we can't even look at our phone without getting taxed then I'm pretty sure driving while taking a photo is also illegal.

    Call or write them a letter asking what the allowances are, you believed you had parked there at 9am, as per your clocks etc.

    personally 2 mins is petty on the council, should be a good 5 to 10 mins either way.

    But I do know if you're in a clearway starting at 4pm, then at 4.01pm your car is towed ;)

    • Though in my experience getting towed out of a clearway is still a cheaper fine than being parked in a no stopping

    It's a No Stopping not a No Parking area. If you were parked by 9am, were you already in the spot before then?

      I entered the parking spot at 9, I was the first in the spot - there were few lined up almost immediately behind me.

    Yes! Take it to court.
    I would suggest that at 8.58pm you hadnt even left the car let had time to check the sign as the photos clearly show.

    Furthermore your time showed 9am.
    Hence there is some doubt about the time stamp.

    A reasonable judge will throw it out

    • Never take the advice of someone who says "judge" instead of "magistrate". They obviously have no experience with the court system.

    Upload the photo they send you and block out the number plate!

  • Just challenge the ticket. More often than not Councils won't fight over iffy stuff.

    Dispute it. This simply shows how pedantic the Council is.
    You are looking at 2min.
    Ask how this time was reckoned, and compare to car clock, mobile clock, and you wrist watch.

    Did the news come on the radio as you were parking?

    You have to place doubt in the head of the reviewer in that all your clocks, even the radio news all indicated 9am.

    News does not come on at 2 min to 9.

    There is another side to this story. I used to work in an area with parking like this, so there would be dozens of us waiting in side streets for 9am to go and hit the parks. If somebody sniped you a minute or 2 early you'd prob want to ring the council yourself.
