Compensation Entitlement for Delayed Baggage (Emirates)

So I returned from a trip to the UK on Thursday night, and my luggage has been confirmed by the airline as delayed. As of now, 48 hours later, no progress has been made. Communication hasn't been very effective.

I filed a PIR on Thursday, and when I search for my claim it's still being traced.

Just wondering what my rights are, and if I'm entitled to compensation? Can anyone share if they've had a similar experience?

    If you have travel insurance, you should be able to claim for delayed baggage…otherwise you won't have much luck with airbline…

    • Same thing happened to me last December - delayed luggage so I was stuck wearing my flight clothes for a night.

      Fortunately, I had travel insurance (1Cover) so I walked over to Marks & Spencer, bought myself some nice clothes to the amount of $250, got my luggage back the next morning, made a claim and got myself reimbursed a week or so later.

    What damages have you suffered? Did you have to buy anything
    I’m sure if emeritus lose it they will pay for it, or you travel insurance, if it arrives Monday or so I’d not be too bothered

    It's lost. Give it a few more days to be sure then contact your insurance.

    Travel insurance will usually reimburse costs if all of your luggage is delayed by more than 12 hours on the way to your overseas destination. It's happened to me before and I got to go on a shopping spree and buy lots of clothes I normally wouldn't buy, and still was under the travel insurance limit.

    However beware most policies don't provide any payout for delayed baggage when you are returning to your home. The reasoning is that if your baggage is delayed on the way to your overseas destination, you don't have any belongings so its reasonable to buy clothes & essentials. However when returning home you presumably already have clothes and other essentials, so wouldn't be out of pocket any expenses.

    If its lost its a different story, and you may be entitled to compensation for the value of the items.

    I take it OP doesn't have travel insurance. The policy is the first thing to check and then to call them. There is more leeway before any compensation on return. But really what have you lost other than the inconvenience. Move on.

  • Emirates offers Interim Relief (IR) compensation to customers who have reported missing baggage but this excludes residents.

    It appears that you would only receive compensation from the airline if they declare the luggage lost.

    I know it's inconvenient but it would have been much worse if it had happened whilst you were o/s.

  • Were you on your way back via a transfer of airlines. Wouldn't be surprised if it arrives at your door step in a week. The airlines/luggage department have full time couriers returning luggage all over Aus. Very lucrative for the courier contractors. Also rewarding as most ppl want their luggage back ie wedding dresses, so are really happy to see things returned.

    • Well I flew Newcastle to Dubai, Dubai to Brisbane, Brisbane to Melbourne - was informed upon arrival to Brisbane

      • You'll get it back eventually once its done the trip around Aus. Have spoken to a guy who does returns. Some luggage have gone on wrong flights and done another trip around the world before it arrives back. Just depends on if there is stuff in their that is of importance for you. If it didn't make the flight to From Dubai to Brisbane they would try and get it on the next flight out. Then it has to get from the Aus stop now to Melbourne. Hence why it is taking longer. We are never flying Malaysian airlines again. Had delayed luggage there and back.

    Baggage delays
    In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1000 SDRs (approximate amount in local currency).

    If your checked-in luggage is lost, damaged or delayed, the airline is liable and you're entitled to compensation up to an amount of approximately EUR 1,300. However if the damage was caused by an inherent defect in the baggage itself, you're not entitled to any compensation.
