Car Accident Not at Fault

Hi guys i got accident today and i was not at fault. Police arrived at the scene and the tow truck take my car to repair yard and they gave me a rental car. My query is that is this the normal procedure. Do i need to check my car and what are the chances of write off. Do i need to do anything. I have informed my insurance as well

    This is like asking how long a piece of string is. Useless without pictures, details of the car's age, etc. Even then, there could be more internal damage that can't be seen from outside.

        2 month old car and in an accident what bad fortune. What car was it. Whats the damage? (adding pics might help) What did the insurance assessor say? Or even tow truck driver as a ball park? Who got you the rental? The police?
        So many question so little to care about this throwup.

        3 accidents? Hate to be paying your excess and premiums.

        If your insurance company find out that you are going through 'mental illness' issues they'll take the opportunity to deny payment if they think they can get away with it.

        Three accidents, even if they're not your fault, says something about the way you drive! Especially if it's within a short period of time.

          Ohh wow. I had four accidents in the last two years. Two were at traffic lights and my car was waiting for lights to turn green. One was where a lady opened her car door without looking and fourth one was a parked car which was hit by a guy who was reversing his car.

          Don't judge people without knowing the whole story.

            @Sweetsugar: Some accidents aren't avoidable, but a lot that wouldn't technically be your fault are avoidable if you pay attention to what's going on.

            I've learnt a lot from riding motorcycles defensively and have applied it to my driving as well. I have been able to avoid certain death and so many other incidents that wouldn't have been my fault.

            On the other end of the scale, you have people who brake hard while there's cars behind them, just drive blindly in their lane and don't notice cars or other objects along the side street that may come out. The worst are those that jump on the horn first and then no longer have time to take evasive action to avoid an accident. I could go on, but being "right" doesn't necessarily mean that you're right.

            Some insurers recognise this and will refuse to insure those who have made a number of claims, despite being not at fault.

      Not necessarily, it just means it’s undriveable

      • Agree, I had one many years ago that I thought would be a write off for sure. Ended up that the repairs were about 25% of the value of the car.

        Dang. Have you spoken to your insurance? Are you and the insurance company happy to use that repair centre for assessment and repairs? If not, return the rental car immediately.

        • I just talked to my insurance but i am not sure if they are good its hume collision centre. I am worried because i just bought it 2 months before. And he is having racv insurance.

        You know you can still claim through yours? If you are not at fault there will be no excess or change to your premiums. Your insurance company will act on your behalf and most likely get a better outcome. Who do you insure with? Plenty provide free rental cars if you are not at fault. They just bill the other parties insurance. And you get a proper rental car not some smash repairers 2002 pulsar sss with bubbles in the window tint.

        i would be claiming through your own insurance as well, provide them with all the details of the other driver

        • If i go through my insurance. What about the car which is parked at yard. They will pick it by self. Or is this a bad idea to go with his insurance.

            @Rexx: Pretty sure when you have an accident, technically (in the PDS it states) you're meant to advise your insurer immediately.

            @Rexx: They will send a tow truck and pick it up. Your insurance doesn't care about costs becausetthey just bill the at fault person's insurance.

          • @Rexx: claim through your insurance and they'll ask you where the car is (i hope the tow company gave you the details of where it'll be towed). I would be going to the car and taking out your stuff like camera, charger etc (don't forget etag, if you're in Melbourne, AAMI has an assessor in Altona and it'll get towed via M1 and you'll get charged everytime it goes through). Get your insurance to tow the car to their assessor, get it assessed and like magic, your car is repaired

    You've informed us here at Ozbargain OP, that's the most important thing.

    Your next step is to post the same questions on Whirlpool then notify your insurance company that you are waiting for assistance from 'experts'.

  • Did your insurance organise the rental car or was it the tow truck/repair yard?

    Hopefully it was the former. If not then hope you aren't found at fault because you'll probably need to pay.

    • Truck yard they said the other guy insurance will pay for it. Thats why i am confused. I talked to my insurance they said thats fine if he wana go through his insurance.

        If the other guy isn't found at fault, for example its 50‰ 50% or yours then you'll need to pay for the hire car. Read the documentation you signed when hiring it.

      • a good indication if the car will be written off is if, the gap between the panels and the door has been pushed together and they are touching.

    Do i need to do anything

    Probably a bit late, but usually:
    - Exchange details with the other driver
    - Take lots of photos of both cars
    - Get the stuff you need out of your car
    - Inform your insurer (which you've said you've done already), so they usually tell you what to do or what happens next…although sometimes you need to chase them

      Yes you are right. I just called the rental cars to return the vehicle and he was threatning me to keep the vehicle until it gets fixed then i got the call from towie. They just think about thereselves. Greedy people.

        Everyone thinks about themselves. Some people feel it is immoral for everyone else but themselves to hold their self interest first.

    • Before i got rental car from the other guy. Now i changed my mind to return the vehicle and go through my insurance.

    solution: buy a bigger tow truck, crash the rental car that the tow truck company gave you into their tow truck, place their truck onto your own tow truck, then say they owe you. possession is 9/10 of the law

      Probably didnt have insurance then, and now have it because its a brand new car and not second hand or a shitbox car with no sentimental value that he can just simply throw away once it crashes into something.

But thanks to those who helped me i just post here because i don’t know the rules as i am living here from 2 years and all this shit happened.

                    @Rexx: I know you came here from India 2 years ago but you need to read up what to do in an accident. Suncorp provide recommended steps in the pds. Please read up on these asap. Also rules are very different from India (where insurance is basically non existent). You really need do some reading.

  • Alrightt, I'll try and actually answer as best as I can.

    So… assuming you've got the other driver's details (Full name, address, number plates, police report number) and you got comprehensive insurance then I'd be contacting your insurance and lodging a claim as soon as possible.

    I wouldn't be relying on the other guy to be found at faulth tbh. They will twist and bend the truth around to the point where you're found at fault.

    I had a case where I was rolling up to the lights, completed a quick lane change and another car cut me off changing lanes into me a second later. He told his insurance that he was changing lanes and I acclerated into him. I showed my insurance my dash cam footage and was cleared immediately.
