Car accident at fault with other party without insurance

What happens in the situation where you are involved in a car accident and are at fault however the car you crashed into doesn't have insurance.

    If you’re at fault then you pay/use your insurance.

  • OP is the driver without insurance I gather. If the other car is insured and they have damage and put in a claim then get their details and go through their insurance. If they don't make a claim as there is no damage to their car and there is to yours and you don't have insurance. Those repairs are your issue not theirs. You would probably have to go through a lawyer to claim that the other driver was at fault to get your repairs done. IMO.

    The at fault party pays… aka you.

    If you don't have insurance, they can then come after you for money.

    If you have comprehensive insurance you submit a claim, have your car repaired and any contact from the other party you refer to your insurance company (helps if you give them the claim number).

    If you have third party property insurance you wait for the other party to contact your for compensation and then make a claim on your insurance to pay them.

    If you have no insurance YOU SHOULD NOT BE DRIVING ON THE ROADS. But, when they contact you for compensation you can ask for a couple of quotes and them pay them the appropriate amount or wait for them to take you to court if you are a douche. Having them take you to court will just end up costing more.

  • Honestly curious but… what if OP (with insurance) keeps putting it off and delaying making an at fault claim?

    Can't you just say to the victim that your insurnace has problem and you don't have any? And for them to take you to court, it'll cost them more than the repairs itself?

      Yes, but if you are the one at fault the court costs will be added to your repair bill. You are under no obligation to claim in your insurance, only to restore the other party’s losses.
