Uninsured car Accident

Hi everyone. A Few weeks back, I was driving a friend's car. Unfortunately, I got into an accident and I found out later that the car i was driving wasn't insured. Now, the other party lawyer has sent me a letter. I don't know how much extra charges they're gonna give me. I'm really worried. Any ideas/ suggestions for the next step? How to deal with this situation?

  • Even if your friend's car was insured, the policy probably wouldn't have covered you if you weren't listed on the policy … NRMA's comprehensive insurance policy for example covers anyone who drives your car (or mine does, anyway)

      I think almost all policies cover any driver, but often with very high excess if they are not listed.

    Assuming you're asking because you're at fault and dont have the money to pay upfront, they have 6 years to chase you for money, so accept you're not getting out of it, ask their insurer to go on a payment plan, pay it off over time, learn your lesson about the cars you drive, done.

      My favourite is 'Accident with a Truck (Uninsured)' where OP asks for help pinning blame on the truck driver… then uploaded the truck's dashcam footage that showed the OP 1000% at fault.

        My favourite is the one that pretended to be the other driver, looking for possible excuses "the other driver" might come up with.

  • Is uninsured vehicle legal or illegal? Because I know a few people are still driving cars without insurance. Police can't even detect this. Funny I'm still yet to hear their accident.

      100% legal to drive without insurance in Australia.

      (not talking about 3rd party injury of course)

        Unfortunately when you are short of cash insurance is one of the things that become ‘optional’

          Other way round, people who are ( basically ) bankrupt don't take insurance. Nothing to lose ( for them ): they just declare bankruptcy.

    Thanks guys for your help , I am still waiting for quotation letter from lawyer of other party insurance. This accident was my fault not giving way in T junction. My car was hardly 20km/hr speed .

    could you please comment how much it would cost just to repir it . On checking there no damage on any lights and windscreens at all . which can be seen in pic aswell .

    Now I am planning to negotiate with repair cost .

      New door and guard absolute minimum. . Possibly pillar bent too in which case it won’t be cheap. Really depends what’s behind the damage you can see.

      I highly doubt you were doing 20km/h if you did that much damage.

      As someone who was also hit at a T junction because the driver, like you, failed to give way, I reckon you're looking at least $5000 for that.

      The least of your problems. You've crumpled the door, fender and side skirt. If there's damage to the wheel or A pillar, even more.

  • Thanks guys for all your effort and support . Your help means alot for me in this situation as in this stage 4 in melbourne I cant physically met my friends and family . I love this community here and really like to thank you again .

    My mate he will fix his car by own and I am only liable for other party fixing and later afternoon I had a chat with other party lawyer they explained me that its 2016 hyundai accent car and total cost is around 10k.

    I was shocked to hear that and tried to negotiate with price as I did some my own research that car would cost around 17k brand new and it was 4 yrs old so its price is 9k-13k at most but they charged me 10k . I felt i am getting ripped off here . I am still waiting for full quotation letter with all pricing and other documents probably thats a demand letter which they gonna email me soon.
    I have requested lawyer to talk to other party to reconsider and give some discount
    Do you think its a correct pricing or over priced and trying to rip me off ..

      You'll have to find more money because that's definitely not a $3500 job you made.

      Maybe they're charging you $10K as the car is now a write-off?

      The car's value is irrelevant to the work, other than the insurer maybe classifying it as a write-off, in which case you would be liable for the whole thing. Just be glad your uninsured ass hit a Hyundai and not a Maserati like this dude.

      That's more than 3.5k of damage. Their lawyer has you over a barrel. At best, you can negotiate a payment plan, but they'll get the full amount from you one way or another.

      If the car is worth 10k, then that car's written off. No way you're getting that repaired for anything less.

      That's the bad news.

      The good news is that you won't get billed any more than 10k.

    You're lucky it's a Hyundai - if you'd hit something more expensive you'd be up for WAY more.

    If you want it cheaper, all you can do is politely ask for a second quote on the repairs. If the second quote is the same or more, then please, don't make an innocent persons life any harder already - just pay them the money.

    In future, buy your own car and insure it. At the very least, when you drive someone else's car, make a quick phone call or complete an online form to get a cover note from an insurance company before driving.

    There is nothing worse than being hit by an uninsured driver and their professional opinion (unbiased of course!) is that the repairs should cost no more than a fraction of what is quoted.

  • You are going to pay whatever the bill is to repair the vehicle. Since you got a letter from his solicitor I would guess that the other car is not insured or only has 3rd party property damage insurance. If they have comprehensive insurance and they claim you will get the bill from the insurance.
    In my view if you can't afford at least third party property damage insurance, you can't afford the car ( personal opinion).

    I had the same thing that happened to me about 12 years ago, same damage as that on a 3 yo Liberty gt, the repair bill was $23,000. I just claimed my insurance, they guy at fault wanted to pay me $10k and not claim . I got my car repaired and I don't know if the insurance co got their money or not but not my problem.
