Got a Parking Fine Even Though I Displayed Disability Parking Permit

Happened in Sydney, NSW.

I parked in a 2P Ticket zone at 4PM and I had my disability parking permit displayed.
Came back to my car 30 minutes later with the parking fine citing "not displaying ticket as required".

I took pictures of my car showing the disability permit as well as the parking signs to use later when requesting a review.

I hopped online to Revenue NSW to try and check the photo evidence the parking ranger took but there's no photo online, it only provides the option to pay the fine, request a review or take it to court. This brings me to my questions:

  1. Do parking rangers not always take photo evidence when issuing a fine?
  2. If there is no photo evidence on the ranger's part, what are the chances of me winning if I take this to court?

Things to note:
- I have checked the information on the parking fine, and it matches my car exactly, so it's not like someone just placed someone else's fine on my car.
- The 2P Ticket time range is 8AM-10PM outside of that it's free. I parked there at 4PM.

    Im a bit confused, Does a disability parking permit allow free parking? or just parking in disabled bays? genuinely curious

    • In Vic it depends on the sign and the permit, but usually you get twice as long for the same ticket price.

      A disability parking permit does not entitle the permit holder to free parking, unless stated on the parking sign.

      Category one (blue) and category two (green) permit holders are entitled to park in an ordinary parking bay for twice as long as indicated on the parking sign (under Road Rule 206). In the case that a parking fee is required the payment required by disability parking permit holders will cover twice the length of time than it would for a non-permit holder. e.g. a disability parking permit holder parks in a 1P parking bay, upon payment of the1 hour parking fee the permit holder may park for up to 2 hours.

    I suppose it's just a case of showing your permit through along with the infringement ticket number and a letter to explain the situation. (Ie review)

  • When you request a review, you will probably get an email to respond to or you can call the office and ask for one. If you are not required to pay if you have a disability sticker you have a pretty good shot if they took the photo (providing your permit is displayed clearly) or even if they didnt as you can (most likely) prove your car is registered to you and so is your permit.

    In Vic they take a pic when making out fine. Write a letter to have fine reviewed. Was the disabled card put in the location in the car as per instructions on the back. Was it clearly visible to the inspector.

    Also on a side note.. Was the card used as it is permitted. You are disabled or you at the time were dropping off or picking up a disabled passenger at that time of use. Not using it just for yourself if only the carer to go shopping. This permit I have noticed alot is being abused. Just saying.

      Agree. Whilst there are many legitimate users, also seen many scumbags in the city milking it.

      No kidding, finding a spot in Sydney CBD for a quick 10 min stop is almost impossible. 8 out of 10 cars got a disabled permit.

    Meh, just pay it. Too much of a hassle to go back and forth only to waste your time and still have to pay.

    Is it your permit, or a family members permit? Is the permit legible and not all sun dried, cracked and broken? Was your permit really in the window or was it only there when you took the photo and that’s why you want to see their evidence?

  • You were given a fine for “not displaying ticket as required “. Therefore they have seen your disability ticket but it is improperly displayed. Perhaps some of it was obscured or back to front?

    ring your states public advocate system if they ignore you, council most likely will budge when someone paid by the state tells them off.

    Write to the local MP saying that you properly displayed your disability permit. They’ll have a chat with the ranger.

    Take a photo exactly how the permit was displayed in the vehicle and post it up.

    Most are issued as the permit is not properly displayed etc, etc.

    PS: ring SDRO in a few days and the penalty will be loaded and ask them to read out the officers notes. Which should explain why they issued it.

  • Happened in Sydney? You gotta be more specific. You sure it wasn't a loading zone? You still need a ticket to park in a loading zone despite being disabled.

    No, rangers don’t always take a photo although most probably do. It wasn’t that long ago that the ranger’s word was all they had and that was acceptable.
