Car Rental Nominated Me for Toll Fine - Had Already Returned Car

I received $165 Eastlink toll fine for car that wasn’t in my possession. It was rental car that I returned in April 2020 and Offence date is in June 2020.

Owner of car falsely nominated fine on my name.

So issue is he’s not picking phone and I don’t have his details so i can nominate him but even if i had I shouldn’t coz he’s car rental business owner and there could be someone else who rented might be driving. So who should i contact. Eastlink??
There wasn’t any contract, but i do have chat which i had with him on day of returning car. Also, there wasn’t any transaction to his account for rent after that day, there was no toll transactions on my account after that day.
*Called Eastlink and they said in their system fine isn’t on my so they forward me to fine Victoria. They said fine was nominated on my name by owner of car. So they said get letter of retraction from that person and send it to them. In case he don’t send, i have to send them statuary declaration saying car wasn’t in my possession. Now am waiting for letter.

  • I once got a citylink fine for a car i had sold. I sent them proof.

    They wrote a letter saying i still needed to pay the fine. I hope Eastlink are smarter.

    • I guess that might means car yet to transfer on buyers name but in my case car was on that guys name and even after knowing it wasn’t in my possession he nominated it on my name which i think is serious offence

        Why don't you call the authority that sent you the fine and explain this? If the car was not yours, there was no rental agreement and you say you weren't driving, I don't think they can force you to pay the fine just because the owner nominated your name.

    • my car was written off, 6 months later i got a fine from EastLink. Turns out my old numberplate was stolen, and whoever took it was using it to drive up and down CityLink. Sent them proof that the car was written off, and it got waived. Annoying thing was, i was getting them pretty much weekly for about 2 months
