Parking Infringement City of Perth

Hi all,

Wondering if anyone had any success appealing a parking infringement from the City of Perth and anything that would help my cause?

Basically parked across motorcycle bays on Hay St unknowingly as the signs on the sidewalk indicated that it was fine to park there at that time. Upon returning to my car realised there were motorcycle parking bays marked and saw a ticket on my dash and copped a $75 fine. Honest mistake but don’t expect them to let me off with that excuse so was wondering if anybody else out there had any luck getting an infringement like this waived and how they got around it, otherwise am probably just gonna have to bite the bullet.

Cheers.

Unlikely.. City of Perth don't mess around.

Good thing we have this thing called separation of powers in Western countries.
The city can make any claim they like, it's ultimately up to a court to decide. IMO if you have a reasonable excuse, the courts are reasonable with judgment, especially for trivial shit like parking tickets.
The real question is whether it's economical for you to take a day off work to sit in court for half a day or just pay up.

      • reasonable excuse
I think the op may have an issue with that one

  • apparently joondalup are lenient on first offence.
    could be similar for perth

    • Cheers. Suppose it’s worth a shot seeing if City of Perth have any leniency.

$75 fine, sounds like a bargain.

Agreed, this should be moved out of the forums into the bargain section.

At that price, I'd get some form Xmas presents to hand out to family and friends…

Or, here’s a thought… you admitted to parking over motorcycle bay and you copped a fine… have you thought about just paying the fine and modifying how you park your car in the future?

  • It's only $75, just pay it. Mistakes happen. Better to just pay the fine and move on with life, I paid one recently almost $300, it stings but you get over it.

    • True, will pay up if I have to. Wanted to see if anyone had any success dealing with appeals and how they did it. If I can save myself $75, why not? Submitted an appeal online and should expect a response by snail mail within 10 days.

The process is you that ask the issuing authority (in this case City of Perth) for leniency, which 99% of the time they won't give, why would they when it's free money for them. Then when this fails you take it to court, who being an independent party will likely give you a fairer hearing.

I've been to court a few times for various tickets, and in my experience the more trivial the offence, the more likely you will get off.
There was one time where a whole bunch of people were there for speeding, drunk driving and parking tickets. The judge rounded up all the parking tickets and told everyone to "plead guilty with reasons" then he let everyone off :) All the speeding tickets and drunk drivers got the full punishment plus costs though, so it's not always a good outcome for everyone.

  • $75 is pretty cheap imo. Years ago when my bf rented outside the West Leedy train station I would park on the verge outside his house (allowed with owners permission), some mafaka who probably wanted free parking called the ranger on me and it was $100. They didn't let me off. Got a parking permit but it frigging slid into my cars dashboard lol!
