Purchasing an Item Second Hand with Receipt. Can I Still Use The Receipt at The Store?

I'm looking at buying a tablet from Marketplace and the seller still has the receipt

What are the laws if I need to use the receipt at the store, if there is a problem with the tablet as I wasn't the original buyer?

This is for JB Hi-Fi.

    I wouldn't expect there to be any issues - the receipt is a "proof of purchase" and useful for warranty claims etc. It shouldn't matter who has the receipt (e.g. if it's a gift for you, you won't be the original purchaser).

    I would expect that you won't be able to refund to a card (usually has to be same card), but you should have normal rights for repair etc, and worst case a refund to a gift card should be possible.

    i would have thought that ACL doesn't apply to second hand sales and that warranty is generally not transferable. Would you get away with it, most likely, are they obliged probably not

    i bought a second hand Samsung off an seller with a JB hifi receipt. The phone developed issues and I ended up getting a full refund.

  • If paid with cash should be ok, If paid with a card then might have issues getting a refund as it would normally have to go back to the original source of payment method or store credit if your lucky.

      They can put it back on to another card if you've cancelled the original card

  • If the receipt has the previous owner's name/address etc and the store asks you for ID, then they will not allow any exchanges/refunds as the transaction was not with you but the previous owner and thus you as the new owner do not inherit the same T&Cs as what was stipulated in the original transaction

      Another person can gift you the item which carriers over consumer rights so it's not just the original purchaser that can claim warranty.
      I think most places will take the receipt as proof and wouldn't question it further
