Car Yard from Hell, How Do I Recover My Money?

I looked online for a cheap car, it was $1999, called up and asked if it was registered. He said no, its $550 for 3 months, you will need to send it over and a deposit. Then he offered me $300 for my car, as a wrecker trade in. So I said before I send any money, what is the total price I am up for he said $2200. The ad did mention in small print, a $550 admin fee, but as I had never seen this before I thought it must be the registration fee.. So I wanted to be sure of the total, that's why I asked the total.

I send over $1550. I get there, take it for a test drive, then he asks me for the rest of the money. He has no EFTPOS, so I drove it to two ATMs, and they won't accept my card. I Thought I only owed $650, he then tells me I owe him $1200. So I got really upset and think about cancelling the deal. The car is not worth $3000. I end up agreeing to pay, so I sign all the paperwork. We then agree he will follow me home, to get the rest of the money.

I get nearly home, and the car breaks down. It just conked out, and then wouldn't start. So he gives me a lift home tells me he will fix the car. I said no, sell it to another sucker, I don't want a dud lemon.. Who wants a car that breaks down on the way home? And he drives away. He has $1550 of mine in the bank. I believe he has transferred the rego to my name already.

What can I do?

          shady used car sales person manipulates you into paying $1000 over the advertised price and sells you a lemon that breaks down, and he was inconvenienced waiting for you to sign paperwork for your old car that he literally stole from you for $50?

        even Kramer and Newman worked out the value in transporting recycling :)

        Drive around to get back 10c a can at recycling, sells used/old car for $50 that has more value than that even as scrap metal. Makes perfect sense.

          The catalytic converter alone is probably worth $150

    • Good luck with buying the next car. Please share when it happens. There will be lessons to be learnt buying a 2 grand car in this new normal we live in.

    • Most cars car that are complete and driving should get at least $300 - $500 from a wreckers. Just have to ring a few wreckers. Or sell it on ebay starting at $500.

    • no they ended up refunding my money. My old car cannot be sold as a car, it is only fit to scrap. They know about the insects.

        The cheapest dealer car on carsales is closer to $3k so im wondering where you found such a reputable used car dealer
        Even facebook marketplace in sydney has only 1 dealer i can see thats got something for $1999, though even that has 3 months rego

    Why are you buying a car almost the same price as your phone? I usually assume they are wreck less on the road that don’t care what happens to their car
    or using it for some criminal activity so it can be dumped once it gets involved with the police

  • In Qld there is a a statutory warranty for cars over 10 years called class B statutory warranty. You get 1 month or 1000km which either comes first. Not sure about NSW… I'm guessing not

    Sometimes I wonder if there's really an underlying mental health disorder that needs reviewing. It's either that or just really poor life skills.
    Anyway, you really need to learn from your errors you can't just keep making these errors. All of the posts show your lack of insight.

      There might be a good thousand of adults here on OzBargain that's sane, logical, critical, and intelligent. But there's another million out there in public who are not. And it's these people who will enable the actions of the aforementioned, and even bail them out of their consequences. That's the lesson we should take from this decade, at least what the likes of the success OnlyFans demonstrates.

    • Cooling off period usually ceases to be once you take delivery of the vehicle. Cooling off period is not a “take it for 3 days and see if you like it, if not, just take it back”.

  • titles pretty miss leading 'car yard' didnt do anything wrong they offered to fix the car and you failed to read the fine print - you purchased as 12 y.o car for 2k what did you expect

    people need to start realising if your going to buy a second hand car with little to no warranty you need to know at least a 'little' something about cars or have someone who does check it out.

    chance are you lost you money if not you have at least lost the initial deposit. Take it as an expensive lesson and move on

    everything sounds like its your fault from what I've read coz you assume too much instead of just asking. Also your fault for thinking a 3k car from a car yard will be without issues. (exception to some Toyota's)

    It turns out its really rubbish and barely functions. I wouldnt expect this for my hard earned money, i expected it to at least perform like a brand new macbook!

  • Buying a new car in COVID times has been painful for a lot of people. A decent running $1000-2000 car has become a $5000 car. I am happy that you got your money back. But play it smarter next time.

    If your rolling the dice and putting a deposit on sight unseen. Try to do the smallest deposit you can to secure it.

    And if your not a car guy/girl. And you dont know what to look for. Spend the $200 and get a PPI.
    Also, unless your willing to work on it yourself. Avoid anything European.
