Tenant rights with removing garden patch?

Currently renting a home, backyard contains a large patch of high dense Fern plants. Probably occupying around 3M-4 metre sq.

To me it's a waste of space and just harbouring insects during summer…what is the tenancy law of basically uprooting these plants?

Have you talk to property manager/ landlord yet? What they said?

Obviously no time, needs to be done tonight.
First check with ozbargain then when the clock hits midnight, get cracking.

      • Maybe OP want to take some advice on tenancy rights then take it to tribunal, if that fails, all the way to high court?

Ask the person who owns the plants if you can throw their plants away

You don’t have any rights to tear up the garden, and suggesting ferns are some sort of insect haven will just make people roll their eyes and take your issue less seriously.

If you make a request in a way that makes a benefit or improvement, the landlord might be happy to say “yes”. Something like, I’d like to replace the ferns with some flowering bushes, or a neatly trimmed lawn. Or whatever you think is good.

But if you start the conversation with seeking to exercise rights to make changes, you are more likely to meet opposition.
And if the landlord says no, ask if there is an alternative they would be happy with. Maybe there is something both of you would like, but isn’t either party’s first preference.

    • This is da wey

    • Yes. Carrots, not sticks.

None…. Its garden, you need to leave it 'like for like' unless your landlord agrees to removal.

if you uprooted my garden i'd just have to replant it, with you as compost

If someone started ripping up my ferns, I would be absolutely livid.
They’re beautiful plants. Leave them alone!

Were they not there when you inspected the property before applying for the lease?

    Need photos to make judgement.

  • You can't kill the plants without approval from your landlord. You will be responsible for the damage when you vacate the property, and the cost to buy and replant the ferns will be taken from your bond.

mskeggs' response above is correct. Offer to replace the ferns with something else/better at your own expense and the landlord might agree.

  • OMG! INSECTS!!!!!!!!!

We have heaps of plants around here including ferns. We actually plant things to attract insects, nature is good. Funny thing is even though there are insects around we never have any insect problems. Maybe a couple of mossies for a few days per year but that's about it.

  • No touchy, if done without permission you are liable to replace the garden to how it was. Mature ferns = $$$$

  • Get permission from LL before removing or doing any major garden/landscaping works.

What you think is a nuisance might be something the LL want to keep and you'll wear the cost of replacement if you tear them up without their OK. Ferns aren't cheap.

Is the house too big? Knock it down and rebuild a smaller house. Driveway a waste of space because you don't have a car? No problems - just rip up the concrete and lay down some grass so you can have a picnic.

Wow OZB sure does host a shitload of miserable people that scour the forums looking to insert useless, sarcastic and vapid commentary to get some satisfaction that's missing in their lives.

If every forum, the answer was "did you check with owner/bible/torah/5th amendment/sex discrimination act/ then these forums would be useless.
The point of this forum, and my thread, is to have an open discussion with varying opinions based people's; experience, being a landlord, knowing a thing about tenancy law, etc. if you dont have this background, kindly take your miserable a$$ somewhere like 4Chan and Discord loser and run your sh1tty thoughts there

There's this thing called common-sense. It seems to be something that some people are truly lacking.

And here you are, pretty much saying that this is the kind of question you'd need help with too.

There's so many questions here that would answer themselves with a just few seconds of thought (if you're capable of that).

  • It's not your garden so don't touch it.
