Is It Possible to Make a Claim for Bond in Vic?

Have officially moved out of property after 5 years, keys handed into REA today. Am I able to claim the bond now before the RE does? I’m in Victoria.

I always see whirlpool posts saying claim before the agency does but I can’t find any links for it. Waiting for exit inspection and report I assumed they would happen today. And last question, Do we need to make claims for overpaid rent? What happens there?

As you can probably tell this is my first time moving out from a rental.

    Yes it's definitely possible. I did it myself because the property manager was completely useless.

  • You'll have to do all the maths yourself re: Overpaid rent and then contact the REA about it.

    Yes you can do your bond application, but don't bother until the final inspection is done. I've never had to do this, the REA has always done it for me, but if you're anxious, go ahead.

    • I assumed the final inspection/exit report would happen the day we handed over keys. To me this makes the most sense but obviously not. I will await for them to let us know when they are doing exit report as I want to be there.

      • I've never been allowed along an exit inspection. They usually don't do it on the day unless someone else is itching to move in.

          When a rental agreement ends, the rental provider or agent must complete the ‘Exit condition report’ section of the original condition report within 10 days. The renter must be present when this happens, or have been given a reasonable opportunity to be there. Reasonable means what most people would think is fair.

    "Claim before the agency does" doesn't really achieve anything other than getting the process moving. The RTBA will advise the agent who lodged the bond that you have made a claim for it, and they will have the a 14 day window of opportunity to contest it.

    By all means do it to get your process underway, but if there are any issues you expect the REA to make a claim on lodging it yourself won't really change anything.

    For rent calcs I believe you have to take monthly amount, multiply by 12, divide by 365 to get a daily amount and then use that as the daily amount given there are different numbers of days in each month of the year.

  • Always lodge the bond straight away, get the timer going on the agent.

  • Out of curiosity does anyone know what happens if PM loses condition report (either their original copy or the copy we return to them with our notes).

    I have my copy plus email proof from the original PM that they received my notes & photos but current PM has messaged me for photos of when we moved in. The property was managed by a different REA to the one that is managing it now we had 3 different PMs during the first REA and then a 4th with the new REA (who have been managing the property for the past 4 months)

    Home has been cleaned inside and out I’ve got pictures comparing the before to the after.
