Anaconda Not Honouring Sale Price

I had ordered and paid for Merrill hikers during Anacondas recent 40% off sale. I received an email a few days later telling me that the order could not be fulfilled and I would be refunded. No other explanation. However I checked the website and found the same hikers in my size we’re still available for purchase only now at full price.
Has anyone come across this misleading conduct from Anaconda before? I have made an ACCC complaint however I know that the ACCC is more likely to investigate when there are multiple complaints about a trader. So if anyone has any similar consumer complaints about Anaconda then please lodge a complaint and hopefully their practices can be investigated.

    Did you try to purchase the same hikers?

      I didn’t. I assumed that if the product was really unavailable they would have updated the website by now. It would be strange If they continue to advertise unavailable product when they have had to manually cancel orders. Anyway I have sought an explanation from them so I’ll be interested to hear from them. However knowing how bad Anaconda are to deal with I don’t expect a straight answer if I get one at all.

    It is not uncommon for X number of stock to be allocated at a discounted price and remainder reserved for full price.

    It's also not uncommon for stock to be replenished, they could have had a stock delivery arrive after the sale.

      You’re right, but there are bait advertising laws that ensure there is sufficient stock available to avoid misleading consumers. Also if there are limited numbers available at the sale price then that should be disclosed as part of the sale terms. Sales are often advertised as “sale ends on x date unless stock sold earlier” if they intend to only sell x units during the sale period and reserve the balance of stock for post sale stock on hand then there needs to be adequate disclosure of that. A lot of sites will tell you how many units of shoes when you select size. By not doing that you expose your business to an allegation of misleading conduct.

    Once I had bought an AIRCON worth $5K ish from WHOLESALEAIRCON for Just delivery cost.

    THEY DIDNT give any consideration no apologizes either just pure attitude. I was happy to take some discount like $500 or something from one of their product if they cannot honor it. I bought item at the advertised price.

    To top it up they even asked to pay an extra like $200ish I think for the shipping.

  • So to update this issue: I pointed all this out to Anaconda customer support and explained that I had also referred a complaint to the ACCC. I then helpfully explained the provisions of the ACL they had likely breached and the potential $10m penalty per contravention.
    To my surprise Anaconda informed me that they made a mistake and would honour the sale price.

    A small consumer win.

  • Don't complain to the ACCC. You complain to Fair Trading who can mediate disputes. The ACCC will only investigate and sue if something is massively egregious.

    Good to see they gave it to you at the original price.
