McDonald's Misleading Glass Cup Promotion - Possibly Daylight Robbery

Hi OzBargainers,

I ordered a meal from the Maccas app and it said I can get a free glass cup. When I went to pick up my order the server said the cup was sold out. I already paid for it and did not receive a Maccas cup and there was nothing they could do. Is this misleading advertising.

There were no signs at the store or on the app saying that the cups were sold out.

I left a feedback and this is there reply below:

"Thank you for taking the time to share your feedback regarding your experience at our McDonalds Restaurant. We sincerely appreciate your feedback and we're very sorry you were unhappy with your experience. You indicated that you were unsatisfied with the glasses being sold out

We will take your comments into consideration to make changes to improve our store experience. We hope you will visit us again in the future.

If I may be of assistance, please contact me below."

Is this a misleading promotion. Thoughts?

    i had a quarter pounder meal earlier today with the family box . i tried to get a glass cup but they wouldn't give me one. i found a hair in my burger though.

    Things can run out, that doesn’t make it misleading advertising. That said. When a company offers something under promotion, they do need to make sure they have sufficient stock to meet expected demand.

    That could be based on previous quarter pounder sales or something. But provided they have some way to explain why they didn’t expect such high demand, they’re in the clear.

  • usually in the fine print somewhere they say "whilst stock lasts" in this case, the stock didn't last. So it isn't false advertising….that being said, i'm sure if then and there at the maccas if you werent happy with the situation AND didn't eat the meal, they would have given you a refund if you asked for it…..if you did eat the meal then sorry you don't really have a leg to stand on.

    • This is a personal matter, it is a thing of honour and principle , lawyers will not cut it. The only resolution can be to declare a vendetta! The (McDonalds) cup of vengeance can only be filled with blood

  • If you get your panties in a twist about something as trivial as that, then you might be in for a rude shock!

  • I thought all these offers had a "while stocks last" they usually even include it in the ads.

  • The last two cups I got from maccas had a round base and couldn’t even stand upright. They were also very thin glass. Probably the worst quality product I’ve ever seen.

    Compared to the 90’s maccas cup which is still going strong after 25 years

    I agree it's misleading, because when ordering in the app it suggests the maccas glass comes with the meal and is a part of the meal. Similar to if you order a regular McDonalds meal and the fries ran out, you should be entitled to a refund.

  • A company that size should have the capability to update the app quickly if something is unavailable. It may be just a glass but it can influence a purchase decision.

    I ordered a quarter pounder and didn't evne know about the promo. The girl gave me a glass and I was so grateful. Maybe karma gave me your glass haha

    I empathise with your plight OP but they will include somewhere in the terms and conditions something like 'subject to availability'.

    It's not daylight robbery. It's an annoying but unavoidable thing. If they didn't offer something in the way of a make good in their response I would push for that.

    They could easily have the app not show the promotion if they are out of cups.
    The truth is they want you to buy and say there are none are left afterwards.

      Yep they could have easily did that and not cheat people to only find out when they pick up there order that there is no cup

    Should have asked for a refund then.
    The purchase should have included the glass but is "out of stock". Shouldn't have made it your problem

      It was my problem. They said they couldn't do anything about it. The receipt said maccas cup, it was missing

  • Are you seriously upset u didnt get the free glass with ur meal? Its just another item to clutter you kit hen shelf, or your parent’s kitchen cabinet (given only a child would be this upset over a promotional drinking glass)

    • Consider yourself on of the few lucky ones. They are limited stock like aldi sales.

      • Checking stores near me on the app they have the glass available to purchase separately, not sold out yet unless they haven't updated the listing yet.

        Don't forget to mention they did nothing after you emailed them. You aren't "unsatisfied with the glasses being sold out", you are unsatisfied with the glasses not being supplied when you were supposed to receive your order, after you already paid and waited for it.

        Sold out means it's not part of the sale

    Had the opposite for me, ordered the quarter pounder meal and didn't realise they already put the glass in the bag so when I walked over to pick it up I asked the staff member about the glasses and they gave me another one in hand - matching pair!

    i ordered a cup on uber eats, paid $4 bucks for it separately, never came, never got a refund! so last time Maccas will be ordered for delivery me thinks, I know its only $4 buck but Maccas have enough to not stuff up or refund.

    Hey I've working in advertising for many years.
    Australia has some pretty strict rules to comply with ACC.
    You can't mislead the customer. Even having terms and conditions doesn't always cover you.
    The advert needs to be clear and show the offer is while stocks last.
    If you think its not clear enough you can can form a complaint with ACC.
    They hand out massive fines to businesses all the time for misleading customers.

  • I ordered a meal deal from them once, a product was out of stock and they offered me a substitute item I didn't want, so said I'd just get a refund, I got screamed at and threatened with police.
    But I really wish these stores would stop taking orders for items they don't have. It's especially annoying when it's the one item you wanted that you don't get but you're stuck paying for the crap it's packaged up with.

  • The app implicitly suggests there is stock available by way of being able to add it to your order. The 'while stocks last' message occurs much earlier on the promotional section of the app.

    So I agree. I'm real angry now. I need some stress leave because of this.

  • What bothered me was not that I didn't get a free cup as part of this promotion (who cares, it's a cup I'll never use), but the fact that the MyMaccas app wouldn't allow you to apply any discounts to the Quarter Pounder meals because this promotion was going.

    I would rather have my discount with no cup, than forcing me to pay full price with the promise of a cup that they don't provide.

    I hate those what a load of landfill. I got 4 last week when I ordered for the family and we had fun smashing them. Such a satisfying noise.

  • I ordered one meal today and was given 6 cups. 3 when I paid and 3 when I collected the food, not sure why. It either some stores got too many or just aren’t as busy as others, so now trying to clear them.
