McDonald's Misleading Glass Cup Promotion - Possibly Daylight Robbery

Hi OzBargainers,

I ordered a meal from the Maccas app and it said I can get a free glass cup. When I went to pick up my order the server said the cup was sold out. I already paid for it and did not receive a Maccas cup and there was nothing they could do. Is this misleading advertising.

There were no signs at the store or on the app saying that the cups were sold out.

I left a feedback and this is there reply below:

"Thank you for taking the time to share your feedback regarding your experience at our McDonalds Restaurant. We sincerely appreciate your feedback and we're very sorry you were unhappy with your experience. You indicated that you were unsatisfied with the glasses being sold out

Is this a misleading promotion. Thoughts?

      • They should have offered you their normal paper cup as recompense/substitute.

      • If they don't give you one, you can legit make a credit card charge back, and you will win.

        I did this when a Cafe gave me the wrong kind of coffees to take away and 1 month later I had the $9 returned to me.

        In your case, the advertised goods weren't received. You wouldn't have bought the meal without the glass.

      OP, you sound like you have lots of free time. Start a credit card chargeback.

            @Tradiebyday: I saw Maccas Coke glasses in local Salvos. Maybe try bin diving middle of the night before they enter the salvos store?

    They usually start handing the ones they didn't sell for free after the promotion period.

    Maybe you'll get one then.

    • I got mine with a BBQ Angus Meal last time. I never really know if the promo is going on, but I'm not a big fan of quarter pounder. Does it allow you to customize it out of the burger and replace the patties?

        You can customise anything if you want. You could completely remove everything in a cheeseburger and add everything in a big Mac - but it'll cost you a fair bit more than just ordering a big Mac.

            @Pinchy: Well the app is limited unfortunately, but Maccas POS will let you do it.

            "Can I get uuuuhhhh a cheese burger, but without the ketchup, mustard and bun, and can you add a big mac bun, big mac sauce, add one pickle, add one 10:1 patty and also lettuce please?"

        But if the glass is $4 with no burger purchase then it is free if the burger isn’t $4 more than standard.

          If the glass is 100% free then why would McDonald's bother with this promotion at all, they are paying to warehouse these cups, paying rent to keep them in the store, they had to adjust their ordering system to include the option, train staff on where to put the glass in the bags, millions in advertising the glass too. Seems like a big waste of time if it doesn't bring in any new orders at all because it is 100% free and 100% of Quarter Pounder meal orders would have been ordered anyway.

            @AustriaBargain: I've certainly gone to Maccas, HJs, 7-11 specifically for promo items. They wouldn't have promos if it didn't get more people in the door. You think they give out hundreds of thousands of dollars worth of gifts for the Monopoly promo just out of the kindness of their hearts?

          It's not 'free' unless you can just walk in and just grab one with no purchase required.

            Do you have to pay any more for the burger than it’s regular price? If not then it is regarded as ‘free’.

              Imagine if the 'gift' was a 25% discount, and then you got charged full price anyway.

            • @Brian McGee: I'd argue the quarter pounder meal does require you to pay more than what should be the regular price.

        It's a promotion to sell that item. If you're promoting something as part of a package to entice you to buy that item and then yank it away after payment, that's deceptive - the person may have ordered something else if it had not been offered.

          Yep, that's right. I'd feel a bit cheated too if the free glass influenced my decision to buy a Quarter Pounder meal.

          Although normally if the glass really did influence my decision and when I get the meal the glass was "sold out", then I just calmly ask for a refund as the contract of sale from their end has not been met. Still would feel annoyed though having to walk all the way into Macca's and no exchange of money to food. However, it's unlikely you can call that "Daylight Robbery", as "Robbery would imply they forcefully took something from you.

          Technically it's not "misleading" as they always say "while stocks last".

          Just my two cents .

          TLDR - I'll be annoyed as it was "Sold Out", but not "Misleading" or "Daylight Robbery".

            @Deridas: I'd feel similar if I ordered the meal deal and then received no fries with it - as they were 'sold out'.

            • @trapper: not really the same, you are paying for the fries they aren't just throwing them in as an extra.

                @jerrus: When you order the meal you have to choose the option of including the glass, on Uber Eats anyway. They don't just give everyone who orders a quarter pounder meal a free glass automatically. You choose it as an option and then you get to be disappointed when your order arrives with no glass. If you choose the default "no" option for the glass then you will be getting what you paid for when the order arrives with no glass.

        If it said it on the receipt and there was no indication at time of purchase that the free item was dependent on whether it was sold out or not, then I'd say bait advertising. If it said something like "while stocks last" or similar, then not.

          If they are still actively advertising the product when you place the order not sure how while stocks lasts cover them. The advertising is indicating its still available..

            @velcrochicken: Like surely they have enough money to allow a store to say they're out of stock of a promotional item.

    Daylight robbery is a bit of an exaggeration, but I’d say in general none of these maccas promos are worth making a purchasing choice over. If you really want the item I’d ask in store before placing the order.

      Yeah, great advice. It's just that my kid wanted the glass cup soo much and I was sad to disappoint. I will do this next time. Life lessons :)

      • Ah yes, these things are a trap with kids. I’m lucky my kid is too young to really know what promo is on at the time. The happy meal toys very often not the one advertised. Marketplace often has people selling the promo items cheap.

      Yes, I remember a free Coke glass promotion a few years a go. I had to go to a few stores before I found the colour I wanted as it had sold out.

    Next time ask if they have the glass cup before ordering.

    I do the same when they have promos like this. I remember calling them up when pokemon cards were in happy meal. Or when Szechuan sauce was re-released earlier this year.

  • Daytime robbery would be when you ordered the glass cup from
    Maccas and they just gave you the free meal with it but not the glass cup you ordered in the first place. That would be a wasted meal that you could fed someone.

      If the free sun roof was listed as ‘whilst stocks last’ you’d probably check it was in stock before ordering though. Not saying I’m not on OPs side, and yes it’s bait advertising, but it’s kind of a known thing to see if it’s available. Online and confirmed on receipt probably does count though. I’m a little surprised that maccas didn’t send a free glass just for PR.

    When the Creme Brulee McFlurry came out I kept checking the app and they kept telling me there were none at my local stores.
    So I didn't buy one.
    If you ordered a meal at a specific store and the app told you it came with a free glass, that's what you should get.

        Perhaps MacDonald's should think about withdrawing the offer for sale from the restaurants that have no stock or a link to a stock watch page?

        Not really fair to the customer to continue selling a product with an included promotion if they know already they can't provide it instead falling back onto the weasel words "While Stocks Last".

          Would be extremely surprised if they even kept tally of the cups in stock at each store. The 14 year olds on the counter would just hand them over to anyone that asked for one and the numbers would be way out of whack.
