Car Accident - Who's at Fault

Hi guys, can I have some of your wisdom please for my first accident. I've attached diagram for your reference:

-Car A, turning right from T intersection. Indicated.

-Car B, going straight from right side to left, similar to car C, trying to do U-turn, no line marking on street. Went to kerb, waited for car C. Indicated

Both car was waiting for car C to pass, collision between A and B happened after car C passed.

Update: Damage was on Car B's front right (minor), Car A's front wheel area, affecting little part of front passenger door

    I am inclined to say that both A and B are morons.

    If you are doing a U-turn you have to give way to everyone, repeat, everyone, else.

    B at fault, especially given there is a roundabout 50m further down Doyle Road they could have used to turnaround safely!

    38 Giving way when making a U-turn
    (1) A driver making a U-turn must give way to all vehicles and pedestrians.

    Come on, could have made it harder than that…

    I'm just going to wait here for the inevitable dunce to turn up claiming B had "RiGhT oF wAy" over A and citing no road rule, just "That's what I was taught when I got my license back in 1968…"

    But, hold on… how was the "front left" of Car B damaged?? Had it already completed the turn? The left side of the car would have been away from Car A the whole time unless Car B had completed the turn and was going back past the intersection Car A was leaving… And how the (fropanity) did the off side of Car B hit the passenger door of car A? Do you have the cars arse about? Car A has front left damage and Car B has passenger door damage, because that makes sense in a U-turn collision.

    Something sounds like bullshit here…

      Car B barely left the kerb following car C, while A was in the middle of road as well following car C.

        Without a picture of where the collision was , sounds like car a pulled out in front of b when b had finished the u turn

            @phoenixi0n: Well, that isnt the "front left" on car B for a start… That is "Front RIGHT"

            And if the front RIGHT of Car B (the yellow Toyota) hit the passenger side of Car A (the silver BMW), then B is 100% at fault.

      I know a u-turning car has to give way to all traffic BUT when does the u-turn stop and he becomes just another car driving along the road? If both cars were going thru an intersection then it would be clear but if you see someone doing a u-turn a couple of hundred metres up the road can you just pull out in front of him because he did a u-turn?

      • No you can’t just hit them because they are u-turning. At some point all drivers have a responsibility to give way to avoid a crash. There is however a hierarchy, and a u-turner is at the bottom of the list.

        • I understand but for how long? If I do a U-turn and then continue on down the road how long do I stay at the bottom of the hierarchy? That's what I'm wondering. But no-one ever seems to know.

          • @rufus001: You when you have completed the turn? You stop, give way, make the turn and at some point you will have returned to the normal travel lane in the opposite direction. Maybe it’s wen you clear the initial lane, maybe it’s when you’ve accelerated to the speed limit or somewhere in between.

            If another vehicle is unable to avoid you before you are at the speed limit in the other direction I’d imagine you haven’t given way but it’s all conjecture and really dependant on the actuality of the collision.

    Person responsible for accident asks Ozbargain community to rewrite law and physics, so they can convince the other drivers, they have 'legal advice ' supporting their case.

    Round about 50m down the road, stupid to do a u-turn there, but I doubt the driver of Car B will learn anything from this ;)

    I dont know which one is the BMW driver but itll definitly be their fault
