Dodgy Boss Directed Super to False Super Account

Hi all, my partner been working for a salon and her boss said she would help her with opening a super account on her behalf. This was about 1 year ago and she was new to the country and she let her boss handled it all.

Now she's quit her job and want to move on with her super but find out her boss' accountant opened her account using false info that's not her true info and now she doesn't have control over her own super. She tried desperately to get him to reveal the wrong info he used to open the account and he is reluctant and most recently he provided info which she used to try to update back to the true information and it got rejected by the superannuation company saying the old information was not correct.

Now she's worried she is going to lose her super or her boss and accountant worked together to steal her money. She can't even tell how much, if at all, there's money in her super account.

What should we do?

    Surely something is in her name. Isn't the super linked to her wages? Can't the fund audit this?

    Is there any information regarding her super in her ATO account via MyGov?

    • This assumes boss wasn't paying her cash.
      Is there an Income Statement (group certificate) in ATO portal?

    Better go to police and report it. This is a fraud, not a mistake.

      Police won't do anything. Need to go to the ATO.

    The tax office will be greatly interested in all of this. Do you have any records of employment including pay slips?

    You lodge a case of "unpaid super" to the ATO. It is unpaid because as it stands you have no super funds in your name. The ATO will handle everything from there.

    Had a similar case where my (also small business) employer opened a super account for me and had payslips showing super being paid. However, after I left I noticed my super amount was still $0. After multiple calls to employer, he just insisted it was paid so I opened a case with the ATO. Took about 6 months for the case to resolve and money in my account.

        Nah, the guy was just a moron. He kept saying he called the super fund and couldn't sort it out. Got sick of the back and forth, gave him a deadline to fix or I just leave it to ATO.

        I was only there 9 months cause he was a moron. Wasn't a lot of money.

  • My husband changed jobs right after our first kid was born, and the 18 months later, had kid #2. About 3 years later, when I was sorting his emails (he doesn't like admin) the Super yearly update email came in and I thought I'd check out how his fund is doing. Over 3 years his boss only made $3k total in contributions. He started asking around at work and everyone was the same and either didn't knew or 'had an understanding'.

    He quit, filed an ATO report which ruled in our favour, but its been over 6 months and still nothing has been deposited. Dont expect we'll see that money ever.
