Can I Get Rental Holding Fee Back?

A couple of days ago, I was about to rent a unit and already paid $500 as a holding fee to the landlord.

But I was told by previous tenants that it was a bit noisy around this unit and this unit is more expensive than surrounding units. He subjectively hid the real situation of this unit. So, I don't want to rent anymore.

I wonder if is it possible to get the holding fee back or partially back?

    Depends in the terms you agreed to, but usually not. If you could get your holding deposit back then it wouldn't be a holding deposit would it…

  • Plot twist - previous tenant doesn't want you to stay there and is going to use you leaving as their bargain chip to get back in with lower rent.

    Have you validated any of the previous tenants claims?

    That's not really a valid reason, you inspected it and now you've received some information that paints it in a different light, you'd be breaking the contract.

  • The thing about doing research is that if you did it before paying the fee, you'd have known it was more $$ than other units. I think that's your real issue and unfortunately that's not on the landlord.
    A bit noisy, not sure what that means, i mean if it's in a main area, noise is going to happen.
