Owner of Koko Black caught gaming the system of Enterprise Agreement. Isn't the dude also own Grill'd which also have problem about underpaying their staff a few years back.

Is this the norm for Australian Owned companies to scamming their employees? It is not like the first time done by the owner or whomever is in charge.

Should this people be penalised? It seems there are no deterrent at all. Those companies lucky enough to escape can YAY and HOORAY but feel sorry for the employees.

Just a random thought to get general opinion of OzBargainers.

      OTR / Peregrine have been doing this in SA for years.

      The amount of "auto trades traineeships" that were just service station attendants…

      I do wonder if they will be able to keep this up as they expand in to the Eastern States and can no longer hide under the SA radar.

    The thing in common, isn't that they are Australian Owned companies, but the person running them.

    Many Australian owned Companies comply with the laws, it comes down to the people operating them.

    Legal loopholes

    If it’s legal then the issue is the law. Try and change it & businesses have a massive sook and threaten to cut jobs etc. Just look at the right to disconnect saga. Businesses claiming it will kill them & they should have access to you 24/7 like you are employed to serve them whenever they want.

    This is a test case, they've picked two employers who'll get very little sympathy from the community and who's agreements are being pushed through at the moment. They didn't "get caught" gaming anything, they were openly gaming it in a way I'm sure plenty of others do.

    I highly doubt this is a small issue, because it's perfectly legal despite being scummy as all hell. The test case will be to make much wider change on how shift allowances are calculated.

    • I live in Sydney and apparently I must have missed the memo (are they still a thing?) notifying of their opening. In my defence, 5 stores in the CBD, 1 in Bondi and 1 at the airport.

    Subway has Australian registered companies, but it is not Australian owned. They are a very shitty organisation so this news is not surprising at all.
