Caught Red Light Camera, 2 Pictures Shows Car at Same Spot

Edit: FINE IS VALID. Just had a heated argument with my mother, I saw the pictures on her phone swiping left and right and I was 99% certain she was stationed (hence my thread). Anyways, my mother plays the victim more than Taylor Swift and lacks logic. Long story short, she doesn't live with me, I told her to send me the fine details, I looked at both of the pictures clearly on my computer and not only majority of her car was over the unbroken line, the second picture shows her moving forward a bit, maybe 50cm? But it's obvious from the two pics she's guilty.

I told her she has no grounds disputing it and she will lose. As she always plays the victim, her excuse is "I didn't know" to tell the judge and I said "good luck with that, way to waste tax payers dollars for something that is your fault", also she's been driving for 30+ years and it still baffles me today that every fine she got, it's never her fault. In the last 2 years, she's been done 3 times in a school zone for speeding and her excuse was "I didn't know there was a camera" and this behaviour ticks me off so bad.

I tried explaining to her she should never be stationed or cross unbroken lines and she's always say "I didn't know, that's my defence" which as you all know, is not a valid reason nor evidence to get out of anything. Anyways sorry guys for the thread.

So my mother got a red light camera fine in the mail. I looked at the two pictures on her phone and it shows her car at night, both positions are exactly the same in the two photos with the brake red rear lights lit up.

In the picture, there's also another car moving straight on the other side, so I assume, mother can't recall that night, that my mother crept up into the intersection but the light went red before she had the chance to turn right as she was giving way to the opposite car.

The only difference is that majority of her car is over the unbroken line.

I am trying to find a source (if anyone can help) if being stationed on an unbroken line (giving way) warrants a red light fine?

I told my mother to try and dispute it as it seems justified.

    Wouldn't have been booked if she hadn't waited halfway into the intersection to turn. If she'd either stayed behind the stop line, or gone all the way into the intersection.

      In that sense, what about peak hour traffic queues scenarios? The same logic applies, right?

      There's a queue into the road you're turning into, but the intersection is queue up aswell. By chance, you happened to creep up as well, but you are stationed on the unbroken line, wouldn't that warrant a fine as well? The queue in the middle goes through as traffic eases up, but since the light went amber then red, you just happened to be in limbo on the unbroken line. I've seen many cars stationed on the line but never seen the camera flash, especially in the city.

        It's your responsibility to make sure you can clear the intersection. You don't queue over the intersection, even when there is not a sign spelling that out.

          Even those you are not to supposed to queue over the intersection if the other side is blocked.

      She didn't run the red light and is giving way to the opposite car, both photos show her stationed at the same spot.

      As I said, it 'seems' justified.

            I saw another one of these yesterday. People using turning lanes to try to jump the queue.

    stop line means a continuous line that—

    (b)  is not part of a marked foot crossing, a keep clear marking or a bicycle storage area for hook turns.

  • You can always request a review if you want - chances are not likely in this case based on the information you've given, however, they are not zero, and they are certainly higher than many other cases that are absolutely clear cut.

    NSW rules are

    Does the whole vehicle or just part of it need to travel beyond the white stop line after the red light appears to trigger the camera?

    The rear wheels need to be past the line before the red light comes on to avoid triggering the camera. The camera is not triggered by vehicles crossing the stop line on yellow (amber) or green lights.

    What if I entered the intersection on a yellow (amber) light?

    Revenue NSW reviews all images and will only take enforcement action when it is clear that a vehicle has proceeded through a red light at an intersection.

          Not really clear cause of the merging car on the first shot but it seems on the line but the wheels are after the line in the second shot. On mobile, swiping left and right, the car seemed stationary but on computer when instantly switching between the photos it's obvious the car crept up a bit.

          So yeah, she needs to pay but her victim mentality wants to fight it even though literally everything is not on her side from evidence (photo) and law. Her excuse is "I didn't know". Literally, she said that to me…. "I will tell the judge I didn't know". And I'm luck.. "good luck", I also told her there's a fine for losing case as well….. She plays the victim everywhere and nothing is her fault….. funny how she had 3 failed marriages and it wasn't her fault. But that's another story HA

    Camera will only tend to go off if there's a change at the pickup (registered by sensing the car's weight/metal). If there's no change the red light won't go off. You can be halfway across the line and the camera will stay off, as soon as you move the sensor will notice and it'll flash.

    One takeaway is that it is LEGAL to be in the intersection (on a green) whilst waiting to turn right, provided there is no red right turn arrow.

    So many idiots sit behind the line waiting for a break in traffic, instead of proceeding past the line into the intersection.

    So .provided it's a green light…and no red light otherwise controlling the right turn, it is legal to wait in the intersection for a break in traffic.

    And even if a red light camera intersection, you won't be pinged for proceeding FROM WITHIN the intersection, because you had already passed the line before the red light.

      You also have people that turn without waiting thinking people have to give way to them, happened a few times to me. Idiots.

    • And one intersection I know with a scramble crossing and no right turn arrow, many drivers who are sitting in the Intersection drive through the red nearly running down pedestrians who the walk signals.

      Now if only they were waiting behind the white line, would the above happen?

    ignorance is not an excuse, but not sure what she would claim she didn't know. That the light was red or that she should stop at a red light ;)
