Strange Warranty T's & C's

Hi All,

Was looking for a present for my son and found the website Mydeal.com.au had what I wanted.

Had never heard of it before, but for what I can tell, it seems legit (maybe).

Looking at an item it didnt mention anything about warranty so I dug further and all I could find was the below statement, does this mean there is no warranty or they are just offering the absolute minimum permitted by law which would be 12 months?

(a) To the maximum extent permitted by law (including the Australian Consumer Law), MyDeal does not give any guarantee or warranty or make any representation of any kind relating to the Site, its contents and the Products advertised on the Site to Users or anyone else.

    They can write it, but it's meaningless.

    What they're saying is they only give a warranty as per the Australian Consumer Law (and other laws). They aren't going above and beyond. When they go above and beyond they'll saying something to the effect of "this warranty is in addition to what is required under the ACL".

    Under the ACL Warranty isn't an automatic amount of time. It's more what is reasonable based on the price and the product. For example you might buy a $25 toaster and it might be reasonable to expect a basic device like a toaster at that price to last about 12 months. But a $250 toaster, you'd expect to last at least 5 years.

    • Just to clarify, if they dont specify a warranty period, it is assumed to be 12 months minimum right?

        Under the law - it's assumed to be what is reasonably expected.

        Practically - it's basically a guarantee against DOA, unless you can take it to court or a tribunal and win.
