  • The fact they even refer to it as a raincheck is infuriating. A raincheck is when you rock up and they are out of stock so you take a raincheck and pay your money. In this instance they took our money telling us they HAD STOCK.

I am going to make a complaint to the ACCC for bait advertising- clearly they did not have the stock to run this promotion
The guy on phone said because they didn't have the stock on Saturday they couldn't fulfil my order, but the stock was back on Sunday

    • I received my order this morning. Out of 56 bottles ordered I received 1 x $1.60 stubby of beer, along with an $11 delivery fee

I don't think it came back in stock on Sunday, we've all been played here.

    • 17 of my 20 out of stock items were available to buy online when I picked up my stock. Absolutely infuriating.

  • I'm getting delivered this Thursday. I haven't got any unavailable or out of stock email yet. Hope they will have enough stock to fulfil my 53 bottles' order.

They'll send you the email on the day of delivery.
I just got mine and delivery was meant to b3 tonight at 6pm

  • For anyone else calling up and complaining about this, I got $50 credit being sent to me via physical giftcard. I had ordered just over $200 worth of liquor, none of which got delivered. Hope that helps someone if you're after some compensation!

    • What did you have to do to get it?
My order was $322 and they didn't honour any of it

      • I had paid for the purchase through a gift card and they had refunded via credit into my account so I was actually calling up to get it paid out via a physical gift card as I hate being locked to using it online only and for purchases over $30.

I was talking to the guy on the phone and told him I had seen the goods sitting at a local Dan Murphys however he told me what everyone else had confirmed - only Mascot was clearing stock. I told him that it was the 3rd or 4th time I've had an ordered cancelled and that I had not been able to make plans for the day given I had to wait for the delivery. He apologised for the inconvenience and offered the $50 extra gift card plus the original amount I had spent. I reconfirmed with him that he was giving me the extra $50 as I was surprised he offered $50 so quickly (I actually thought he might of meant $15).

All in all, I didn't really push or ask for it and I was only on the phone with the guy for less than 5 minutes.

        • I was only offered $15. Don't think I'll get anything now based on how the rest of the conversation went….

    • And on a scale of 1 - 10 how nice were you and how persistent did you have to be?
$50 seems disproportionate to the order total when compared with the other credits mentioned above.

      • I was super surprised at the amount offered too. I didn't do much at all - see above for what I said.

    • The woman I spoke to gave me a $29 voucher - $9 because i didnt want to pay for delivery considering they couldn't even do it properly (delivered 2 out of 9 items) and $20 for the trouble, i had to persist a little with her that I was unhappy, dont expect them to offer it straight away. Note: This was last friday night after my stuff had/had not been delivered.

    • Orderd $206 worth and only got $27, at least they didn't charge for delivery, but might try complaining to see what crops up - how did they mess up so badly - doesn't the program tell them when it's all ordered?

  • Yep, out of stock for 12 of 14 things. Getting a bottle Jim Beam Honey and a chocolate bar. Not quite the things I wanted most.

  • So is there any recourse here? anyone having any luck arguing the point?

I talked to a customer service rep and wanted the call escalated, was told I would get a call back as no supervisors were available. Nothing so far but I will be following this up further.

Points to note from the Australian Consumer Law:

Misleading conduct, sect 29: "A person must not, in trade or commerce, engage in conduct that is liable to mislead the public as to … the quantity of any goods."

Bait advertising, sect 35: "(2) A person who, in trade or commerce, advertises goods or services for supply at a specified price must offer such goods or services for supply at that price for a period that is, and in quantities that are, reasonable having regard to:
    (a) the nature of the market in which the person carries on business" (aka Woolies are able to supply large amounts of alcohol, it's what they do).

Wrongly accepting payment, sect 36: "(3) A person must not, in trade or commerce, accept payment or other consideration for goods or services if, at the time of the acceptance:
    (a) there are reasonable grounds for believing that the person will not be able to supply the goods or services" (If you have one store filling these orders, what do you expect will happen?)

Woolworths is a national chain and has the means to right their wrongs by moving stock from around the country. The website is a national website and does not tell you what warehouse stock is coming from or show you stock quantities at each warehouse. You assume you are buying from Woolworths, one of Australia's largest alcohol distributors.

    • All strong points. I tried with my customer relations rep but gave up. Wasn't worth it in the end. Good luck with it if you do pursue. They will tell you it is impossible to fulfill your order.

    • Got a call back and was given the "while stocks last" and the "terms and conditions" lines, see 16.7 and 17.1.

Nothing overrides the ACL, even T&Cs or store policy. I'll be taking this to the ACCC and Fair Trading.

      • Please turn it into a class action and I'll be happy to pass on a bottle of my winnings to the cause.

  • 11/12 were unavailable for pick up after a 2 hour return trip, and I went in the shop and they had stock.
Called their customer service and they were giving the useless reason of its from Mascot warehouse.. blah blah I told them I CBF where its from all I know is they are from Woolworths. I was quite pushy and asked for them to fulfil their order since they accepted my payment in the first place and I do not accept the reason out of stock. Their supervisor mentioned terms and conditions "while stocks last" but I didn't see that anywhere during my purchase nor from their emails. I told her I will write a letter to Fair Trading and call ACCC. She said go ahead (I got her name and time of the call also). I will defiantly persuade this further. It is quite clear they stuffed this up by giving the make up online credit, it can also be called as bribe in other words. Don't give up ! fight for what you deserved.

  • Has anyone actually tried to use the goodwill credit they supposedly gave us? I can't see it anywhere…

  • Update after taking it to Fair Trading.
