Coles Pre-Paid Returns - 2 different staff say NO.

Just went to look at a telstra buzz at Coles https://www.ozbargain.com.au/node/206301
They wouldn't let me see one out of the box and had no display model.

Telstra shop next door had no stock

Went back to coles and said "if I buy one and its unsuitable I can bring it back right?" and got an emphatic NO as the answer from two separate staff members.

They cant legally do that can they?

    Consumer obligations

    Consumers’ rights are not limitless and the consumer guarantees do not require you to provide a remedy unless one of the guarantees has not been met.

    For example, you may not be required to provide a remedy if a consumer:

    • simply changes their mind, decides they do not like the purchase or has no use for it
    • discovers they can buy the goods or services more cheaply elsewhere
    • has damaged the goods by using them in a way that was unreasonable.

    Sounds an awful lot like that!

    GPS connectivity, some brands are good some are not, my current LG has never had a fix, my other samsung gets a fix near instantaneously.
    Some of the ZTE's apparently had hot battery and charge issues.

    • That's not 'unsuitable', that's a problem with the device, which is different

  • I recently took a pre-paid phone back (was one of those $15 ones with the netflix code) because the sim had expired and wouldn't activate. They tried to argue with me and just give me another $2 sim (which I was fairly sure wouldn't activate the netflix credit). In the end I insisted and they gave me a refund.

    This comment is probably completely pointless to you though, as Spackbace has already mentioned, the store does not have to offer a refund for a simple change of mind.

    During ZTE prepaid sale of $14.50, I returned two handset without any issues. Both handsets were faulty and stopped recognising sim after few days. Second time got refund back as Coles were out of stock. Second time, I returned handset after 2 weeks but still no issues.

  • Change of mind returns policies differ from store to store. Certain things like prepaid phones cannot be returned, because they contain a consumable one-time use item (SIM card and it's activation) and because the phone is a carrier subsidised device, the supplier does not allow the store to refund the item unless it's faulty.

    Legally the retailer is not obliged to allow you to refund or exchange your item if it is not faulty in anyway. If the shopkeeper says you can refund or exchange under change of mind, they are just doing what company policy tells them to and not because it's legally required.

    It's just that a lot of stores do it and we are mentally conditioned to think that it's a legal requirement to allow a change of mind refund.

  • i bought a nokia from one of the recent coles sales, and returned it. Said it was network locked and this wasn't explained to me when i purchased it
