Land with easement on side vs easement at the back?

Would you prefer a land lot with easement on side or at back? I am interested in a land that is 15 m wide and 25 m depth, but it has 3 M easement on side. Anyone with their house building experience what are the suggestions?

  • What in particular are you worried about? It probably means you own all the fence rather than sharing it with your neighbour. If it's an area with a lot of foot traffic and people could walk through you might find that a privacy concern?

    • Ok!! The lot that I am really interested in is 15 meter wide with # meter easement that I have to have free off any permanent structures on it that leaves me with 12 meter front. Then that 3 meters go all the way to the back (25 meters) 3*25 meter is a lot of are that I would never use. In saying that if it was towards the back I would not have mined it as I could set a nice backyard at back. Sideyard sounds bit awkward though.

  • My personal preference is easement at the back as then you can use the area as your secluded private open space. On the other hand side easement means a larger and less private area cannot be used. Back easement you will not be able to use 15mX3 = 45m, in case of side easement it will be 25m x 3, = 75m. Most lots you will find will have greater depth than breath, so these considerations will apply.

    • exactly, I just explained the same in the comment above. Sideyard would look real funny and will waste a humongous amount of land right!!!

    Your lot is not big enough to sub-divide later. Otherwise again back easement case be used as a SPOS, side easement of not much use. You best bet would be to look for one without any easement. If you must have an easement then look with a smaller size easement. If your back easement is 3m, it would mean the block on the other side of your property will either have no easement or it would be around 1m.

    The bigger issue isn't just the size different (45sqm vs 75sqm) but the fact that when building a home generally the width of the land is more important than the length. Having 12m to play with will be much more limiting on what builders you can go with than losing 3m at the back.

    3m down the side would make it easy to access the back yard to park a boat or caravan.

    • or rent to someone who likes building an Ark.

    • not planing to have a backyard as only have a lot of 12*25m for building even if I have a small one it wont accommodate anything like that.
