However, the story ended well. I disputed the claim and received a refund on the ENTIRE order, not just the hard drive and B & H appealed and lost, so I got the other $700+ of merchandise free even though I only claimed for the hard drive. Thanks to the BBB.
That's a terrible analogy, if something isn't boxed it's not new AFAIC, they could be selling me any demo item etc. Even if the box has been open that's potentially a factory second. Keeping the box at least 5 minutes to test something works doesn't seem like a big ask, I keep my boxes until warranty is up in case I need to send something back in most cases or maybe I just don't want it I can sell it with the box.
And while I believe they should have refunded you for the hard drive, I don't think it's fair to take them for an entire order, I don't knoe how that works, was it through PayPal?

B & H sent me a DOA Western Digital Hard Drive, which they refused to return OR exchange as I had thrown out the outer-cardboard from the OEM packaging. I had to send it to Vietnam, to WD, at $60 cost.
