Claiming Owed Money (Less than 10k)

Hi just wondering if anyone has any experience in a similar situation.

To cut it short, someone owes me money from a contracting job, and it has been 4 months since we finished that job. The problem is that, the person was a contractor himself, so the main company doesn't care since they paid him, and they don't want to get involved. The person is ignoring calls and messages, and from time to time he says that he is going to pay us on a certain day but he doesn't.

We are going to write a letter of demand, but I doubt that it will help much, and I we contacted some lawyers that said that their fees + court fees would be of 8k, and it didn't guarantee that he would pay, or that he would do it anytime soon. If he claimed to be on bankruptcy, then we'd have to forget about getting the money back, but we'd still have to pay the 8k. I am currently trying to find out if going to court without lawyers would be a possibility, and how much it would be.

Has anyone been on this situation? What did you do, and how did it go?

    Take it to small claims tribunal. That's really your only option

    • or goto a debt recovery agency, they take a hefty %, but its better than nothing.

  • If you have good doco on the debt and willing to write off say 50% you could try selling it to a debt collector.

    • Mick Gado offers these services, 50% of something is better than 100% of nothing.

  • Write the letter of demand. You need that for small claims most of the time anyway to prove you have tried to recover yourself.

    Does he have an office? Take your and anyone elses kids, take them for icecream, tell them to touch everything and refuse to leave until the bill is paid. That's how my mum got a 9k bill paid when I was little lol.

    is he having a cashflow problem and are hitting up clients for 60% deposits on aircon installations?

  • I was involved in a similar situation previously. Completed some building work on 30 day account for a builder which got blown out all the way to 6 months. Enough was enough and called debt collectors.

    Debt collection fee is negotiable depending on $ and how old it is.

    Going to court is pretty expensive. If there's other options consider those first instead. If you want more info feel free to pm me.
