Speeding Fine Plea Down in WA?

Hi all, regularly drives on this stretch of WA country road (usually 110km/h speed limit) for the past 6 months, but on a small stretch of road with 90km/h speed limit (less than 500m, it's 110km/h before or after), I might have got done for doing around 120km/h (saw a hidden red flash).

Look, I'll admit I'm no angel here, and this is definitely not my proudest moment! I'll admit I got complacent for driving over that same stretch of road for the past 6 months usually around 100km/hr with no speeding fine before, and honestly on that night, I did wanna just get home as fast as I can after a bad long day at work. Bear in mind, that 90km/hr stretch is no town area, just a big well lit junction area with no real traffic, hence the complacency for me at least.

My record was zero demerit point in the last 6 years. I actually haven't received the fine letter yet, but I just can't it out of my mind, which could potentially be $800 fine & 6 demerit points! Just wondering if there a ground for me to plea down the speeding fine based on previous good record? Long shot, but no harm asking I guess.

Go easy on me guys, learnt my lesson & just trying to minimise the damage if there is a ground for doing so. Cheers!

    Pay it. $800 is highway robbery, but you don't seem to have anything uncommon to argue. Rushing child to hospital for example.
    I sympathise. Maybe rig up a speed alert program on an android phone.

  • If you call up the fines dept and offer to pay immediately they will waive the points.

    You could wait for the fine to come in then work out what to do. You might have been seeing things and the flash was not a speed camera.

        You could always check on the WA Police Fixed Camera Locations website and see if it is located on their list…

        • Got done before long long time ago, so I recognise the flash. Like red flash, instead of white.

          Or you could just click the link, scroll down the page and see if it's on the Police list… It also lists "mobile camera sites"… Hell, let me know the location and I'll do the searching for you…

          And I have never seen a "red flash" speed camera. I witness people getting speeding fines from cameras on a daily basis, and none of them are red. All of them are white. BUT, with that being said, I am not a speed camera operator or engineer. I am not in WA, so I am not privy to what technology is used in WA to catch speeding drivers.

  • don't know about WA but here in Qld I can register and log onto the dept transport web site and check my license/ rego details (due date) etc and any type of fine if its been issued and how many points you have left on license.

    This registration works on your license details and links to all your registered vehicles

    Maybe thats what you could do check to see if any fine has been issued before asking for ways to reduce any consequences?

    90km/h zone and a well lit junction… sounds like the 90 zone exists for a reason. The fact that it is well lit indicates to me that it’s a bit of a black spot for accidents. The whole area sounds like it exists just to minimise accidents at this junction.

    You also mention that you travel this road quite frequently and have done so for some time, so you are aware that the zone exists. Based on that, I don’t think that “complacency” would be an adequate defence. The 90 zone is less than a km long and would have no discernible affect on your traveling time, so time also doesn’t appear to be a factor.

    Even if you don’t end up receiving the fine, I hope this serves as a wake up call. Big, well lit, reduced speed zone areas don’t exist in the middle of nowhere unless it’s an accident black spot. Who knows, one day, slowing down for that 500m section may just save your life.

      Similar with road work of 80 in motorway. The soonest I do 80 a lot of other cars still doing 100 and over take me.

        Just have a read of the thread posted here not long ago regarding speeding in construction zones and the general mob mentality was "If there are no workers there, I'll go as fast as I want" or "If it looks safe, then the work zone signs are bullshit and I'll go as fast as I want…"

    This is called revenue raising. Who likes their revenue streams being questioned?

      OP was exceeding the speed limit by 30kmph, happy for revenue raising is this circumstance.

      • Not gonna argue with that, it's my fault going over limit,but those private operator had to setup at the small questionable 90 zone in a usual 110km stretch of road, 100km from Perth in the middle of the rainy night.kudos for the guy for doing its job, definitely getting big paycheck from me now.

        • The point of the fine is to be a deterrent. If it didn’t hurt your pocket you would have no incentive to stop.
          You even said in your post you have been doing 100kph for the last 6 months, just be thankful you haven’t already been caught.

      For some reason it's "terrible" that "revenue raising" speed fines occur … but the Australian population votes in a GST on themselves which (profanity) them and everyone else on every purchase they make while the business selling the item doesn't pay tax.

      I mean get your revenue raising concepts under control because voting for a GST was stupid.

  • you can take it to go court but it will probably cost you more as you will actually have to appear on 2 maybe 3 different days. (days off work = lost pay), you will have to pay costs (around $150), and a lawyer (you don't have to, but that would be a stupid thing to do at least pay the $10 for the duty lawyer)

    If you had a bad day why turn it into a shit day by speeding.

    If could have also been your last day if a car pulled out and you collided. The speed reduction areas on highways are there for a reason. Either the intersection is really dangerous or someone has already died there.

    • Did you not read? I got complacent as I never saw mobile speed cam in that intersection before. But anyway, definitely bad day turned worse.

    You basically state that you normally sit at about 10km/h over the speed limit, and have done so for at least 6 months.

    You knew this was a risk, and were eventually caught, but seem to think because you haven't been caught before you are entitled to a discount?

      No offence, but when you drive 110km/hr every day, 10km/hr more is like nothing.

      • That's just a poor excuse. That 10km definitely matters if you hit someone as a result of your negligence.

        Your post and replies are full of excuses when the fact is you went over the speed limit intentionally for a 6 month period. We're meant to feel sorry for you that you were caught?

          Never ask for sympathy.. At the end of the day, I feel perfectly safe at my chosen speed. Speed is never a killer in accident, it's always the lack of attention and sleep.

        I am not sure why I would be offended by that. 10km over is 10km over. It is not a lot, but it is over the limit. I am not going to pretend I don't do it, but if I F up and do it past a speed camera or when the limit changes (or both), I am not expecting any leniency because I haven't been caught before or for a long time.

        • Well said, djkelly. It’s the same mantra repeatedly heard along side the other catch phrase “speed doesn’t kill, sudden stops do…”

          Across Australia, speeding as a cause in accidents represents about 40% of the road toll deaths just on its own and contributes towards over 20% of all serious injuries. About 2/3rd of these accidents happen at speeds of over 100km/h. But this is all shortly to be overtaken by mobile phones and/or distracted drivers…

          Speed is never a killer? The crash statistics tend to disagree…

        • @pegaxs: maybe I should rephrase, speed don't kill by itself, it's the combination with lack of attention that kill. I could have drove 70km/hr in that zone and still kill myself if I were to play with phone and hit an oncoming traffic. Theres a reason autobahn in Germany don't have much casualties, and some part of road in rural goes to 130km/hr

  • My record is 0 points and 0 fines since I first got my Ls in 2003. So 6 years (and my number of years too) is nothing really. Why stress about it before you know if you have a fine? Then jump on Ozb and ask again.

      Don't need to be on the high horse now. I'm no angel like I said. Tell me, who on earth never sped before especially on country road with no traffic in the middle of the night, and 10km/hr over is so easy with no cruise control. Unless you're one of those who stay 20 below speed limit.. Then the road users hate you anyway

      • Absolutely everyone has broken the speed limit at some point on some stretch of road somewhere. I get what you mean but also understand other people's view on unnecessary speeding's risks.

        To answer your question, there are lawyers that can argue your case for you and potentially decrease the penalty, if at all it even arrives. Sometimes they don't. Relistically though, it's not the end of the world and will be a lesson learnt. Exactly the purpose of a speeding fine.

      • I’ve done the crime, paid my dues and learnt from it, o still occasionally exceed the limit and if caught I’ll be paying up because it’s a decision I’ve made. If you are prepared to speed, you need to be prepared for the consequences.

        You knew the limit yet think it is stupid, you exceeded the limit and think it’s acceptable to do so. Now you potentially have been caught -> time to pay the price.

      Wait till it goes to Fines Enforcement Registry and then you can pay in instalments using Time to Pay. Check it out;
