5km over in a 110km/h Zone Gets a Fine in Victoria!? Really?

Just received a fine for speeding on the return to Melbourne, on freeway in Broadford.
110 km/h zone, Detected 118km/h, adjusted to 115 km/h.
I was speeding, I don't dispute that, & I'm hoping to get out of it because of a clean record.

But, 5 km over in a 110 km zone!? I thought you had 10% leniency when it was over a 100 km/h zone? Can someone clarify the rules?

$201 is very expensive considering I was doing 5 km over on a freeway!

  • There isnt any leniency in Victoria, you can get done for 61 in a 60 zone, but one of the good things is that if you haven't received a fine in the last 3 years you can ask to receive a warning.
    NSW has a tolerance or leniency usually about 3km/h, 5km/h and over most likely you'll get done. But most cops seem to be looking out for people doing 10 or more over the limit. NSW warnings are given if you haven't received a fine in 10 years, warnings are only for minor offences like 10 and under.

      Let's not spread false information here. Plenty of that elsewhere.

      Mobile cameras will only detect you if you are going at or over 64km/h in a 60km/h zone, because mobile cameras have a tolerance of 3km/h.

      Doing anything at or under 63km/h will not trigger the camera, as you would be at or under the 60km/h limit.

      (For fixed cameras, it's 2km/h unless signposted limited is 100km/h or over, where it's 3%).

      • Correct, and the speeding ticket that comes in the mail always has the two speeds identified clearly - detected speed and adjusted speed (usually -3km/h).

    The cameras in WA are supposed to allow 2k over the limit. A cop also told me that when in the car they allow 2 k over. After that pay up, you naughty person.

    When they read your speed as 118km/h, you're actually doing 122km/h on your speedo, speedos normally are 4km/h higher than what you're actually going. - so you know already that according to your speedo you are well beyond.

    The laser detects that you're going 118km/h and other bs then compensates for errors so they give you the benefit of saying hey we read you as going 118km/h, but we're going to book you for the +-4km/h to the lower speed, so you were fined at going 115km/h.

      This is incorrect. Australian Design Rule 18 sets out the accuracy standards for vehicle speedos.

      Until July 2006 this rule specified an accuracy of +/- 10% of the vehicle’s true speed, which means the speedo could read under.
      Newer vehicles the speedo must read your true speed or over, but never under.

  • Yep Victoria sucks arse. Cops are just another Labor arm of government revenue raisers so the state government can boost their road/transport infrastructure budget. Then they tell us how they've spent billions 'saving lives', and Daniel Andrews will say "and I make no apologies for that".
    On the day I moved from SA to VIC I got done for 63 in a 60 zone. Because 63 is so much more dangerous, it deserves to be taxed. Yet here we do 40km/hr in school zones!! In SA it's 25km/hr. And Vic govt says they're saving lives.. it's BS. Any 1ton+ object will kill peds and other motorists at 40km/hr.

    The speed limit is a limit… and for not knowing this, i would therefore recommended forfeiting your license ;).

  • They have to draw the line somewhere! If they made the threshold 6km/h, then those fined for doing 6km over the limit will complain about it not being a 7km/h threshold.

  • If you were detected at 118km/h then my bet is the speedo in your car would have read at least 124km/h as car speedos usually read a 3-5km/h higher than the actual speed and the detected speed is also around 3-5km/h higher than the actual speed, and they give you an extra 3km/h leniency on top of that therefore you could realistically have received a >10km/h fine so you should think yourself lucky.
