Help Regarding Suspended Probationary Licence

Hey All.

My cousin who is an International student and holds a Probationary Licence here in Melbourne, Victoria.

He recently received a "Demerit Point Reminder" Letter from Vicroads dated the 1 October 2018; of which he was advised to contact them by the 17th to retain his demerit points/licence.

He has claimed to only have received the letter in the mail (confirming) on the 8th of this month and when he called Vicroads (8/11), they obviously advised him that it was already too late to extend the demerit point period.

I asked him what the reasons were for losing all his demerit points and he stated it was most likely due to speeding.

He currently has exams for university and his uni is an hour from his place of residence as well as the need to travel to work. Is there anything he can do ?

I understand that the loss of points and careless driving is wholly on the license holder, but if I could get some positive advice it would be much appreciated.

Edit: He had received an initial letter from Vicroads around September which he did not see as it fell to the bottom of the letterbox.

Positive advice is that he's lucky he didn't hurt anyone while speeding. Uber exists, take this as a lesson.

And check the whole letter box in future.

    • +4

      And stop speeding.

    There's plenty he can do:

    Take public trasnsport
    Ride a bike
    Uber
    Taxi
    Car pool with someone
    Walk/run

Seriously, why do people post this crap? Your cousin should obey and respect the road rules

Don't forget that they can roller skate, roller blade, skateboard, hand walk, etc.

The options are only limited by your imagination!!

      • +1

I like rolling along the grass myself.

        • +1

That is problematic when you need to cross the road.

Seriously, why do people post this crap?

Because they think they are better than everyone else and above the law.

    Positive advice?

Tell him to stop blaming everybody and everything else for his problems, and he'll stop having issues like this.

    Also… "cousin"

  • +11

Everyone cops the odd speeding fine now and then but if he's speeding that much as to lose all of his points then probably better is he's not on the roads until he wakes up to himself.

    Lol cousin

How do you not see a letter at the bottom of your mail box. I call b/s, suck it up and get a bus, stop blaming it on other people. Grow some balls and just deal with it and grab a bus.

But but but… the dog ate my homework…

  • +7

Why don't you drive him , help a cousin out

    • Thanks cuz!

    • +1

exactly, listen to your uncle and give cuz a helping hand

  • +5

better for Cuz to have a suspended licence than him/her killing someone then fleeing back to whatever country

  • +7

Driving is a privilege, not a right. Your 'cousin' has lost his privilege to drive. Hopefully this is a lesson.

    • -3

Nope. It's only a privilege for non-citizens, it is a right for everyone else (assuming they pass the test that is).

      • +1

        Lol, no, just no.
It’s actually one of the questions in the theory test these days.

    Not vicroads issue

He has claimed to only have received the letter in the mail (confirming) on the 8th of this month

Sure it too didn't fall to the bottom of the mailbox?

Wouldn't have mattered, his ran out of points.

He currently has exams for university and his uni is an hour from his place of residence as well as the need to travel to work. Is there anything he can do ?

Get up earlier and catch a bus.

and he stated it was most likely due to speeding.

In THIS country you can't keep speeding away. At the end of the day, they broke the law many times, had many reminders and ignored it.

Its a case of too bad, so sad. Suck it up and move on.

First step, your cousin should get legal advice. Then maybe he can appeal to get a work license. If this fails, contact the lecturer, student union for advice etc. It is better to do this earlier rather than later. They will take into account your circumstances when grading etc. This is useful if your cousin gets a grade that is a borderline fail.

    • the dudes at uni, no 'work licence' will be granted.

Suck it up and take the bus like normal people. International students spending mummy and daddies money are no different than the rest of us.

      • International students spending mummy and daddies money are no different than the rest of us.

They are. They spend rich mum & dad's money to pay someone to do their assignments
        xD

      • Post says he works as well.

        • True, but as a

          International student

they are limited to no more than 20hrs a week work.

Regardless just because you have a 'part time job' doesn't give you a free pass. Why have laws at all? 90%+ of the population that drives can claim the job card.

          • @JimmyF: I did not say that. Seems like there is a hierarchy in this country that must be obeyed at all times. People have no idea about the "traps" at uni and in society in general.

      • take the bus like normal people.

Abs shows that there are >19m registered vehicles in Australia. Normal Australians drive.

        • And when they don't drive, what do normal people take then?

  • +1

It's not hard to stick to the speed limit instead of endangering everyone around you.

  • +1

We don't have a high-speed tolerance like they do in other countries.

He is on his P's and needed his license so therefore he shouldn't have sped.

I asked him what the reasons were for losing all his demerit points and he stated it was most likely due to speeding.

Was it or wasn't it? How would he not know?

Remind him that going to court for driving while suspended will probably result in the loss of his student visa.

It's an expensive lesson that he will have to learn.

    • Maybe he's been on his phone, running red lights, etc and isn't sure what he's been picked up for in the past?

  • +1

    Excuses, excuses!
Do the crime and do the time - no sympathy!

  • +1

Tell your cousin to reflect on his actions for the 3 months while he is suspended, then once he can drive away, make sure he doesn't speed again.

  • Positive advice?

I'm positive that your so called 'cousin' deserved what he got. Another self entitled person who thinks they are above the law and can drive the way they want.

Driving is not a right, don't do the crime if you can't do the time.

You don't LOSE demerit points - you GAIN them btw.

    • It depends what State your licence is issued in.
