Sales Staff Sent Me an SMS from Their Private Phone. Is It Illegal or Simply Immoral/Annoying?

Hi

I purchased my wedding band from Michael Hill last year and obviously had to give my details (Name, Address, Mobile number etc). Now, I've had an SMS from the person who served me saying that they will look after me, give me extra discount if I come in and see them to purchase anything else.

Now to me (I'm happy to be proven wrong), that seems like a strange thing to do. It's not through an official outlet (it's from their personal number and not a company number or email and they're a retail assistant, not an external rep), so I was wondering if that's illegal?

I'd be interested if anybody had any links in regards to who can contact you and how it must be done?

Edit: FYI -

Unsubscribe option – all marketing or promotional messages (whether via email/SMS) must contain a functional ‘unsubscribe’ feature, that allows the recipient to opt out from receiving messages in the future.

    When I walk in the CBD, there are people trying to pass flyers or something to my personal hand, with their personal hand. Is this annoying/illegal? Who can I contact about this?

  • I had a strange situation where I viewed a house. I then got a group text which had details on the house…. but also had all the recipients mobile phones listed too. Meant I knew all the other peoples details who were interested in the house along with them knowing I was interested too. I advised the sender that I wasn't happy about it, and they apologized. I don't think it was done intentionally, but I'm sure everyone was also a little annoyed that their contact info was shared!

    • Either they are useless with technology and didn't realise all the contact details would be shared, or
      they did it intentionally so everyone would know there were multiple parties interested.

      Either is bad.

    Are you trying to gain a further discount by use of the "unsolicited correspondence" theme? If so… let us know how that works out.

    If not, I feel sorry for you to go through this huge dilemma of a single txt which has imposed itself on your life and wellbeing - without which you would be better able to concentrate on your family or work duties and will now require weeks/months? off to recuperate.

    Options:

    If you don't care: Ignore the message or block number
    If you aren't interested: Reply back saying 'Not interested'
    If you are really unhappy: Contact the store to make a complaint

    Technically the employee most likely did something against the store privacy policy, but they were offering you a good deal if you came back to them in the future. I don't really see anything to get too worked up over

  • Maybe if OP sees it this way he would be less inclined to think he is being "annoyed". The salesperson was just doing his job, selling. His sms is just like a wave to you when you walk past his shop, and since you bought something from there before he was more friendly "how did the last purchase work out? Is there anything I can help you in the future don't hesitate to come to me!"… You know what, nevermind. OP probably needs his lawyer with him at all time.

    No sure if trolling. Why wouldn't you want a contact you can rely on in retail sales?

    I try to actively build rapport with sales staff in stores I frequent. They can hook you up with deals (employee discounts), let you know that a certain item you've been eyeing is about to go on sale, and sort you out with after sales service if needed (warranty claims, refunds, etc).

    Ridiculous, over-sensitive reaction to such a trivial matter.

    Call the cops, they'll put that person straight in to prison, confiscate their phone and execute their family. The Australian public will all be able to rest easier at night.

  • I was shopping around for a new car over the past few weeks. Few car salesman called me from what appeared to be their personal number.
    I didn't see any problem with it.

      That was… entertaining. I read about this when it first happened I think (for anyone else, this was the Maccas Monopoly thing where people said they one prizes but it turned out they had stamps from past competitions). Also the Court in the class-action lawsuit basically ruled it was more likely than not the people claiming had actually kept old stamps from the previous year and tried to pass them off as valid stamps.

In order to make sales and to provide great customer service they have reached out to you in the odd occasion you may need to purchase an anniversary, birthday, Valentine's day present. If you do they might be able to give you a discount since you previously made a purchase with them. I see nothing wrong with it.

    I had a phone call from a mobile and was also. Michael Hill I bought from last Christmas. Deleted voice mail and moved on.

    you then get mad when someone does contact you.

    tell me how you came to the conclusion it was someone calling from their personal phone and why does that matter when they are contacting you in the course of their employment trying to sell you products by the company who employs them.

    Also let me know how it goes if you take a legal action.. every once or twice a week i keep receiving calls from adversing firms regarding electrical or gas supplies… i keep telling them am not interested and yet again next time its a different person from different firm offering all sorts of crap. 😂.

    NOT their privae phone. It is most likely their work phone If it is their private phone, call them on a Sunday night, ask them to come over and help fix something. Maybe say roof is leaking or your locked out of your house and need someone to help lift you up to get into window. Send them to different house with a ladder etc :) .
    All sorts of ways you could annoy them, if it is not their work phone (but probably is dedicated work phone which they turn off when not working)

    The opt out clause is to reply saying "No thanks, please don't message me again".
    It's just a sales person doing their job by er….making sales.
