Is Shopback committing misleading and deceptive conduct?

I purchased gift cards on Ebay back in April. This was to make use of Shopback promo and Ebay discount code.

The gift cards I purchased were not listed in Gift cards category and therefore I was able to successfully apply Patch Code.

Shopback is now rejecting cashback stating "Your cashback was rejected because you purchased gift cards. Even if they weren't listed as gift card initially, eBay Australia does actually look at miscategorized items to ensure they are not paying on things they are not meant to be paying cashback". My rationale is Shopback should have clearly that the gift card purchase is not allowed at all rather than just stating only gift card categories are not eligible.

My purchase was shopback promo so I am losing big here.

Is it deceptive and misleading conduct from Shopback's end?

        Yes it was

        https://www.ozbargain.com.au/node/452105

Cashback is not applicable for items in the following categories:
        Cars, Bikes, Boats (9800)
        Coins (11116)
        Gift Cards (184609)

If someone was deceptive and trying to con ebay by listing it in the wrong category, a smart person would've realised that eBay will realise and fix it

        You seem to like technicality.
        Well, technically Shopback said:

Cashback is not applicable for items in the following categories:
        Gift Cards

        and not

Cashback is not applicable for items in the following Ebay categories:
        Gift Cards

        And what did you buy?

        I purchased gift cards

Shopback can only remit Cashback they receive.
eBay screened out your non-qualifying miscategorised item purchase.

    Nothing to see here.

Ebay members that continually find ways to violate policies should be banned.

No, it applies here because the same comments come up of your inability to read the terms you're agreeing to

PS I hope you're not starting your case with VCAT as "so I was trying to sell some unlawfully obtained Google Home Mini codes on ebay, something which is against the terms of service of the promotion".

I actually hope he does. If only it could be recorded.

  • Sellers listing items in the wrong category doesn't change the type of item.

  • Sorry, nope. Didn't intentionally attempt to deceive or mislead you. There are/were T&C you could've looked into. You tried to see if you could do something in the hopes they wouldn't notice it - they did notice, and you lost. It was a risk to not read through their policies regarding something that you were going to 'lose big' on.

What category were they listed under? If it was a mistake by the seller, then you should probably take it as a lesson learned.

I went through so many of this guys comments and post. It’s one sob story after another.

It reminds me of the spivs and en-tre-pre-neurs at the council blocks on the east end. A modern day Del Boy but with the charm and wit

Given OP's post history where they sought to buy eBay gift cards, and the fraudulent Google home mini codes they tried to sell on eBay, I'm also wondering if op bought from themself to claim the cashback.

Wouldn't be too difficult if they operate their own store to 'accidentally' sell those gift cards in the wrong category…
