Is MegaBuy being unreasonable? '...at the time of ordering the stock had been sold to another customer...'

Please tell me what you think about this issue:

MegaBuy advertised stock for a particular price, and I bought stock at that price. I've bought stock from Megabuy before, and usually they ship very soon after purchase, so when I didn't receive an update (i.e your item has shipped) I contacted them. In fact, I contacted them 3 times via email over 7 working days, and each time I was told to wait for an ETA. On the 7th business day I phoned the store directly, and I was told that I would not be sent my order. According to the person receiving the call, MegaBuy made an 'internal mistake' and I bought items (2 LG32UD99-W) at promotional prices when the promotion was over.

However, I didn't see anything about a promotion on their website, or anything in relation to the end of a promotion. All I saw was the item price and I bought the 2 items at that price. What was also interesting was that the staff member told me that there were at least 5 LG32UD99-W monitors in stock, but I wouldn't be sent any of the stock because there were no monitors in stock for 'the price I paid', and the monitors would go on promotion again in another 2 weeks and if I wanted to have the monitors at the price I paid, I would have to wait until that time. I asked to speak to a manager, but was told non were available and I should send an email to management about the issue.

I followed up with an email, and received this in response:

'Thank you for your enquiry. Unfortunately, at the time of ordering the stock had been sold to another customer before you and we’ve been quoted a lead-time of roughly 2 weeks (20/08) for us to receive more stock at the low, promotional price you’ve paid.

'We are able to source stock from another supplier at a far higher price; however, we cannot cover the difference would need you to pay that IF you need stock urgently, as it’s no small amount.

'Alternatively, I’m happy to cancel this order and provide you with a full refund if the above is not suitable. There are no other options at this stage, as the units were sold virtually at cost, so we cannot provide further discounts/coupons.

'Please let me know how you’d like to proceed, as the backorder is still in place with our supplier for the estimated stock arrival date: 20/08.

My gut reaction from the beginning was of disgust. I feel that I went into a contract with Megabuy for products they advertised and they took my money for said products. If they didn't have the products 'at that price' then they were falsely advertising said products. My feelings are that if they made a mistake by not changing the price of a product and they continued to advertise the product at a particular price, then that is their fault and the business should absorb the cost.

These are just my feelings however. Please let me know what you think? Am I being unreasonable?

    Products run out.

    Things - like updating web pages and product prices - take time. There will be a lag between stock running out, that showing up on the stock management system, someone being notified, and the price being changed.

    Plus, you haven't suffered any harm - you paid $XYZ, you'll get $XYZ back.

      You mustn't be very good with the ladies if you think telling someone to 'calm down' when they are upset about something is a good idea.

      • Not physically present, can't be hit or smacked haha. Don't worry, I thought that one through. But seriously, this is an "out of stock, sorry order cancelled" thing that happens pretty commonly.

        If OP is "disgusted" by this, I'd hate to see how they handle any actually stressful or upsetting situation.

          • @ChocolateBurmese: Not in the SKU that's on sale. That happens commonly. "Promotional stock" is still stock.

I get your point, but I buy hundreds of things off the net every year, and I have never been told after a purchase that they are out of stock. Even this time they were not out of stock, they just refused to send it to me for the price I paid and the price they advertised it as.

    This situation sucks and I feel for you. Personally I would tell them to keep the money and ensure they put aside 2 of the monitors in a couple of weeks when they are at that price point again. Would also ask if they could provide some compensation for the stuff around - some monitor cables, screen cleaners or something.

      Thanks. I told them I'd wait. I guess I'm old school - if you advertise for a price then you sell for that price, you don't take someone's money and then say sorry you can't have it for that price - bad luck - we have 5 in stock but not for you. I think next time I'll be more cautious who I purchase off.

        Actually, it can be for you, just not at their promo price.

        They say it was a promotion. Unless you can prove that it is not, it's your word against theirs. If it was a promotion price "whilst promotion stocks last" then what they have done is fair.

        It sounds like an honest mistake and seeing as how you've bought from them before without incident, shouldn't that work in their favour? Ie. Benefit of doubt?

        • I checked out the page thoroughly. I never saw any thing about a promotion or 'whilst promotion stocks last' statements. Had they not told me it was at a promotional price I wouldn't have known. Yeah, they have been quite good with previous sales - so I'm just surprised at what happened. Any way I'm over it now. Was angry for a while but I've cooled off.

    No - I do not think you are being unreasonable.
    I think they are being unreasonable, and potentially acting illegally.
    The issue is, what are you going to do about it?
    The reality is that most breaches of the ACL are for amounts that are too small for most people to take court action over. Retailers know this and depend on it.

  • I’ve found mega buy always bad to deal with. They always list stuff as in stock when it isn’t.

    I will never buy from them again.

    • That might be true, but breaking what I see as a contract between customer and business - especially after money had changed hands - is never a good look.

  • Yes, they are. Albiet the reason I'd be annoyed is getting 2 different answers to what you asked.

    If you can wait the 2 weeks and the discount was good do that and get the monitor. Otherwise just take the refund. A pain? Yes. But beyond venting here/Reddit there's nothing you could do (and if there is it probably isn't worth the effort).

    • Thanks. I'm waiting the two weeks as it was a good deal. It took them 14 days to tell me about the error (order went through on the 25th of last month), and only then after contacting them 4 times, I think that's what got me so annoyed at them.
