    • They don't do house visits, which it sounds like this one does. Not saying it's a bargain though. In any event, I think most OZB members will already have a will (http://www.ozbargain.com.au/node/45074).

      Will kits are crap. It's not a bargain - you might spend $25 today, but your estate may have to pay $10k-$40k later to sort out the legal mess you created because you were too cheap to get a Will done properly.

          I'm a lawyer and I've worked in a firm that specialises in Deceased Estates Litigation. I've seen first hand how bad will kits are. I've seen estates run up legal costs of $40k because of problems with the will kit.

          They know what they're doing - offering a crap product to make money, misleading people into thinking that a DIY will kit will suffice. They certainly ARE NOT selling a high quality Will product that will always suit the user's needs.

        • Haha wisc, nope I've never even heard of this firm (I'm from Vic anyway). I'm just annoyed to see the poster's deal getting negged for stupid reasons.

          Comparing it to a willkit price is like saying "why would I pay $90 for that 2TB hard drive when I can get a 200mb hard drive from the computer market for $1".

        • eviltom, as a fellow lawyer who has reviewed the contents of the DIY Will Kit, I can say that while not of the highest quality, they not entirely "crap" either - at least not for everyone. For people with extremely simple affairs, eg one property, bank savings and car going to kids in equal shares they are often fine.

          I'm sure you'll agree the problems experienced by said estates would have been either due to complex affairs, poor/ambiguous wording used by the deceased to describe the effect and intention of the will, or both.

          From memory the will kit I reviewed did state that for complex affairs seeking proper legal advice was recommended and also provided contact details for discounted assistance in preparing the will professionally.

          Having said that, I do agree with you that professionally prepared wills do have their place and certainly provide more certainty that the deceased's true intention will be carried out - provided of course greedy relatives with little or no share in the will don't litigate :)

      • It is not the will kits that are crap it is the people using them not assessing their suitability for their circumstances that create the problem.
        Also not taking due care when completing them ads to the problem.
        In the right situation and completed properly they are fine.

      yes people are silly & bugger them up, but so do some of the expert solicitors/lawyers/legal type people who prepare them.

        I find this unlikely, but please provide a link or a reference of some kind so that we might all benefit.

      • but can you find one cheaper that comes to you… i think it sounds spamish, can't be bothered searching for other bargains.

        only side note, just make sure you can select the execuitor as many companies force you to use theirs and it costs an arm and a leg… they can take HUGE %ages of the estate.

        • I don't know about HUGE %ages - 5% is usually the max, and most places would only take a max of 2-3% (if they take a commission at all, many charge a flat fee for acting as executor).

          It seems very unlikely to me that they would attempt to make you to use them as an executor. I mean VERY unlikely. I can't say with certainty though, I've never heard of the firm - but it would be against general practice and very unethical.

        • ok- friends used a free bank (bendigo?)will kit even at 5% (lets say on a normal home and assets 500k) thats still 25K for not much!

        • Well the 'free bank will kit' explains it all. Commission is the scam that lets the bank make its money.

          On the other hand when you pay a firm, you are paying for a service so they don't need to try and scam you for commission to break even.

        you can always find somewhere that's cheaper. but who's to say there's quality? estate planning is so much more complex and will kits are for most likely generalised and basic.

        They'll include how to plan to distribute super as well which isn't normally covered in wills. there are also nominations you need to make. nominations that are non-binding may not get what was originally intended by the testator (will maker) for superannuation and is at the discretion of the trustee to see which dependant will receive the benefit. There's much more to wills than this for example the capital gains tax concession and much of it will be confusing for someone that isn't educated in this field.

        it's the same as getting a plumber that costs $500 or a cheapo unlicensed plumber who charges $150. sure you can get it cheaper but this plumber who's charging $150 probably will be using low quality parts and will be taking shortcuts to offset his low price.

    $125 is very expensive for a basic will. Should be around half of this.

    • Not really. Can you indicate any firms that only charge $75 for a Will?

      • $125 is well priced IMO. but it depends on your situation really.

        for a basic will, i.e. maybe you have your own home and savings maybe a bit pricey as you might opt for the will kit which might be $25-50, but for $70 more you'd be making sure that everything in the will is done correctly. you wouldn't want to have a will deemed intestate (partly complete or no will at all) where you'd have to spend alot more time in order to rectify this.

        edit: I don't see anywhere in the ad which says it's a basic will?

    It doesn't sounds like a bargain, our solicitor did ours for free.
    It all comes down to the complexity. The real cost is executing the estate, that's where the solicitors clean up

      Looks like a small firm or even sole practitioner. That's not a bad thing necessarily.
