[Solved] Someone Parked in My Driveway - Can I Get Them Towed at Their Expense?

So sometime within the 30 minutes of my wife leaving this morning and me taking the kids to school, someone has bizarrely parked In my driveway. Its not like there isn't vistor parking literally 10m away, or more parking easily available up the street. I figured they will be gone soon might have just had to pop in quick to one of the neighbors..but its been 5 hours now. Can I call a tow and this gets billed to the owner? Never had to deal with such an odd situation

    all good so called the copshop and its one of my neighboors (they cant say who for obvious reasons) so thats a load off my mind. Im sure I know who it is too although they arent home which is what confused me, perhaps someone dropped his car off at the wrong spot or something, who knows. Anyway mystery solved, mostly!

      Yeah it's all well and good to get worked up and angry with baseball bats ready and tiki torches lit until you find out it wasn't their fault but some dimwit from a service centre or something.

      • the car but not the number plate. and like i mentioned it was very weird for them to park there and not at their empty drive, and leave it there most of the day. Havnt had a chance to speak yet but something must have come up or soemone else parked it there for him

      Very wise of you not to do anything bad to the car. It may well have been the car had been off being serviced or repaired, and the repairer dropped it back to the owners home, but got the address wrong. Silly, lazy mistake, but not the owners fault.

      • Nonetheless the service guy should know better not to park in front of a drive way (even if it's your own driveway it's illegal to park).
        But kudos to op for being patient.

      I had a google but the issue is most of these posts are people parking across driveways but in the street, this one has literally parked IN my driveway. I tried next door but no one is answering and I doubt they would do that or have a visitor do that anyway

    Don't slash the tyres but deflate them - atleast 2 is enough to give them some inconvenience that they will think twice the next time.

  • i remember hearing that tow trucks can't remove illegally parked cars from private property as it's considered "theft"

    get the tow company's address for the holding yard so you can advise the driver when they come knocking.

    haha thanks for the responses. Im not keen on doing any vandalism or anything silly like that, the thing is they parked my garage in, which luckily my cars not in it. im working in full view of it and keeping a lookout for anyone coming back to the car. my bet is some karen couldnt be stuffed walking 'all the way' from the visitor spot (its a white mitsi SUV).
    Ill give it till this arvo then ring a towie I guess, not much else can do realistically other than wait

    Call your council and they will action it asap. Especially if the car is blocking your driveway

    • they are not in council property, they are on private property entirely

      • How far back in the driveway is that car from the street? It could still be council's.

        • strata complex, the 'road' directly behind this car (and my driveway) is an access road for other units. nowhere near public land

    Could be a stole vehicle or someone up to no good. Call your local police station, ask them for advise.

    Contact the police and report that a registered vehicle has been abandoned and has been parked in your driveway and is causing a traffic hazard.

    Worth a try. Maybe it's really stolen and has been abandoned.

    • yeah i might. at the very least they might say if its one of my neighboors, which i dont mind as much although still weird. if its anyone else, free game

    • This. Ring police and advised a vehicle has been dumped in your driveway. Provide the rego and they will call the registered owner. Might be the nudge the owner of the car needs to know that they can't park there, or alternatively it might actually be stolen and dumped.

    What if they had an emergency? No need to act childish, call the police.

    • yeah this im actually starting to worry about. the cop said he couldnt get a hold of the owner on the phone. no-one is home (or answering). he wouldnt park there normally (his own spot is empty). All assuming its who I think it is of course.

      • If they passed, I suppose the car is now your property, as I am convinced it was their will, that' why they parked there. Congrats on another car.

    If you have a trolley jack, jack it up and push it out into the street. Have had to do this one a few times over the years.

        • …wheels…..of course…why didnt i think of that?! …still need to be fairly buff to pull/push it even on wheels if the car weighs megagrams…..what about inclines or declines? How are you gonna deal with those?! What if the wheels get bogged in the grass, sand or wherever it's in?

            That depends on the surface, and gravity. Based on other posts i suspect brendanm pushes said vehicles out of a mechanic workshop and probably had a few bods to help.

            Obviously it’s harder to push over soft surfaces, especially if the wheels are small. No one said it was easy or always possible, just that it can be done.

    I have been through this in Melbourne recently. We had an ahole parking in our car park at work for 2 months. Because it wasn't on the road or foot path the council wouldn't touch it. The cops didn't want anything to do with it and after 3 weeks of pestering the cops they finally gave us permission to have it legally towed. Every tow truck company we called didn't want anything to do with it for liability reasons.

    After 3 months the ahole moved his car and parked a different one there.

    • In this case I would take it as a personal challenge to get creative and move the car out. Jacks, rollers…

      • Don't think I didn't do that. The old man has car rollers that go under each wheel. But it is on a slope and next to a busy road. There was nothing I could do that wouldn't have been super dangerous to the public.

    • Our work deals repeat by blockading them in with a few pallets, and taking about 30 minutes to remove them when asked, because the fork lift driver gone out for lunch.

      Any tips how to do with it? Asking for a friend… who lives in NSW…

    • Which is pretty much impossible to do, if the handbrake is on. Autos are even harder as if you put an auto in park, it locks the gear box. Manuals should also be parked in gear which combined with the handbrake, make it impossible for someone to push.

      Even if the OP got their car (likely a low power and torque vehicle), I doubt they'd be able to successfully use their car to push or pull (with a strap) down the drive way. A heavy duty winch on a 4wd would do it though.

        Front wheel drive probably need 4. Rear wheel drive should get away with 2

          That's more for moving around just spare wheels and tyres, not the weight of the whole car. You want a set of positioning jacks a.k.a. go jacks. The arms wrap around the tyres and jack it up from the ground, and you are able to push the body and reposition the car on casters. It won't matter if the transmission is locked or the steering is locked or if the handbrake is on.

      • It's not impossible to do. You can easily drag one car with another, especially if you can get the right angles to drag one end at a time.

  • If it is your driveway, then yes… they are illegally parked upon your property. Contact Police for advice, or towing company.

  • I feel sorry for people who live near schools. Must be hell dealing with it daily.

    • I have sprinklers that shoot the mud from the ground in all directions and onto illegally parked cars. Easily solved ;)

    In NSW, Local council allow 2 minutes time when a vehicle prevents entry to a property, ie across drive. They do the fines and hopefully drivers learn not to do it again. Camden Council take particular pleasure near Oran Park primary school at drop off and collection periods. I've seen parents/carer's park in the driveway of surrounding homes up to the garage door to let kids off, stay for walking to school, wait bell for assembly and then return up to 30 minutes later. Parking IS a problem in a poorly thought out new development, Council is making a motza but as usual they approved these a developments to make money.
    The bus zone at Oran Park is regularly patrolled and the ranger takes photo evidence.

    I have had multiple people park in front of my drive way for several hours and stopping me from either taking my car out or parking it in if i was out while it happened. Every time i called up the cops and they kept saying they will contact the person and issue a ticket etc etc but nothing ever happened.

    cute - as usual - failure to communicate clearly - OP's 'my driveway' turns out to be strata - presumably common property - which changes the perspective somewhat - from private to shared property …

    • From how I read it, you’re incorrect. OP said that moving the car from the driveway would block strata property. That is different from saying the driveway itself is strata owned. Most strata properties with shared access work like OP described.
