By VIC Law What Are The Obligations for a Company to Honour a Mistake on Their Website?

Looking for a BBQ Smoker and found a site that has a few listed for $0 and a few more listed as $0 but is sold out. If I select the item that is $0 and go through checkout it seems to go through. My question is, Title above "Do they need to honour it?" I know its a simple mistake by the web dev but just wondering. I know we see stuff like this come up on here all the time from Amazon/eBay/Harvey Norman/JBHiFi/OfficeWorks.. etc.

    Retailers are not required to honour price errors.

    Multiple pricing occurs when a business displays more than one price for the same item or service. If this happens, you must sell it for the lowest displayed price or withdraw the item until the price is corrected.

        (5) Despite subsection (2), a displayed price for goods that is a displayed price because it has been published in a catalogue or advertisement ceases to be a displayed price for the goods if:
        (a) the displayed price is retracted; and
        (b) the retraction is published in a manner that has at least a similar circulation or audience as the catalogue or advertisement.

  • The only mistake would be in enabling you to put it in your cart. It says in big letters "Pricing not available online, please contact store for further information." What are you expecting to happen here?
