  • Is it legal to sell these designs?

    • -1

      It's probably like redbubble, they don't actually print themselves, they also don't do the design, they just facilitate sales. No one is going to have any luck suing the zillion individuals ripping off trademarked designs nor find wherever the printer is in Asia and hold them accountable.

      So it's not legal, but there's no real way of stopping it.

        Printed and packed in Australia as mentioned on their site, not in any way similar to Redbubble or the now terrible (Redbubble owned) TeePublic.

        Majority of these sites pay varying amounts to artists who have intentionally uploaded or leased their designs for a commission/portion of profit…both Threadheads in Melbourne and Limitee in Sydney seem the most legitimate and are definitely competitively priced to the garbage quality I’ve experienced from the aforementioned. Haven’t ordered from Limitee personally but as others have said AS tees are quality and Threadheads uses a similar if not identical product.

        This offer might tempt me to try Limitee though. Thanks OP

          I didn't mean the artist, I meant the actual trademark/copyright owner. The only reason the pants have never been sued off Redbubble/TeePublic is that they aren't actually responsible for ripping off the design.

          https://www.limitee.com.au/collections/movies-t-shirts/produ… - This is one Disney lawsuit away from the entire site going down. It's only that they're small enough to not bother.

            @freefall101: Ah yes…spare a thought for Disney…and the other copyright/trademark holders…but it is the designers having a field day with fair use and not Limitee or others that re-sell the designs legitimately. So then these massive companies should sue the designer, surely not the marketplace, because anyone can set up a marketplace?
            Like you said, too small to bother for the behemoths like Disney, I certainly don’t condone blatant plagiarism versus work that pays genuine homage or takes artistic liberties in the process of creating something new and unique, (can’t be said for all the designers/designs though).

            • @TwinVader: Totally agree, I was just answering the question of whether it's legal. Precedent is that a simple marketplaces can't be sued, however they're not just reselling the design, they're printing them too.

              I couldn't give two shits about Disney, but a lot of small gaming/movie companies get caught up in this too and are powerless, then get abused by the likes of Redbubble. Same laws being broken, even if Limitee is the far less shitty party in all of this, it's still just taking someone else's designs and printing it.

              I'd rather they do the right thing and take down anything that's an obvious breach to support the real artists. Star Wars quote in a Star Wars font with Star Wars icons is not a parody, no matter how you look at it.

            @freefall101: Hi Freefall101,

            Generally, most of the designs that we got from our artists are covered under parody and fair use guidelines.

            Most of people who wear our shirts gets the joke of the two different properties being mashed together even if not everybody understand it.

            In saying this, when we received any Digital Millennium Copyright Act takedown requests, we will handle it right away and remove the design from our site.

            To be honest, the reason we started Limitee is not to sell rip off designs / properties, but simply because we want to promote awesome parody tees, designed by independent artists around the world, while trying to make it as affordable as possible for Australian fandoms compared to other big POD sites.

            Regards
